Le juge en chef de la Cour f\u00e9d\u00e9rale Paul S. Crampton a rendu public hier un jugement<\/a> rejetant la demande de la Premi\u00e8re nation Hupacasath (PNH) \u00e0 l\u2019effet qu\u2019elle devait \u00eatre consult\u00e9e avant la ratification par les Conservateurs de Harper du Trait\u00e9 Canada-Chine sur les investissements.<\/p>\n

\u00ab Je tiens \u00e0 f\u00e9liciter Brenda Sayers et la PNH pour leur courage dans leur lutte contre ce trait\u00e9 d\u00e9vastateur. Ils se sont battus pour nous tous \u00bb, a d\u00e9clar\u00e9 la chef du Parti vert du Canada et d\u00e9put\u00e9e de Saanich-Gulf Islands, Mme Elizabeth\u00a0May.<\/p>\n

En mai dernier, les partisans des Verts ont amass\u00e9 28 000 $ en vue d\u2019appuyer ce combat l\u00e9gal. \u00ab Quelle que soit leur d\u00e9cision pour ce qui est d\u2019en appeler de ce jugement, nous appuierons la chef et son Conseil \u00bb, a d\u00e9clar\u00e9 Mme May.<\/p>\n

\u00ab Malgr\u00e9 cette d\u00e9faite, le combat contre le Trait\u00e9 Canada-Chine sur les investissements doit se poursuivre. La cour a invoqu\u00e9 que les cons\u00e9quences du Trait\u00e9 sur la PNH n\u2019\u00e9taient qu\u2019 \u201chypoth\u00e9tiques\u201d. Il est cependant normal de faire des hypoth\u00e8ses lorsqu\u2019on se pr\u00e9sente en cours pour se prot\u00e9ger contre un dommage potentiel \u00bb, a d\u00e9clar\u00e9 Mme May.<\/p>\n

\u00ab Il n\u2019y a toutefois rien d\u2019hypoth\u00e9tique dans le fait que ce trait\u00e9, s\u2019il est ratifi\u00e9, liera les Canadiens pendant 31 ans. Cela donnera \u00e0 des mastodontes \u2013\u00a0 d\u2019\u00e9normes entreprises propri\u00e9t\u00e9s de la R\u00e9publique populaire de Chine \u2013 le droit de poursuivre le Canada si ces entreprises jugent que des lois briment leurs attentes de rentabilit\u00e9. Rien de tout cela ne va dans le sens des int\u00e9r\u00eats du Canada \u00bb, a conclu Mme May.<\/p>\n

Le 9 septembre dernier, le Premier ministre Stephen Harper signait avec la Chine le Trait\u00e9 Canada-Chine sur les investissements<\/a>. Ni le Parlement ni le public canadien n\u2019ont pu lire le trait\u00e9 avant le 26 septembre, date \u00e0 laquelle les Conservateurs l\u2019ont discr\u00e8tement rendu public. Depuis le 2 novembre 2012, le trait\u00e9 peut \u00eatre ratifi\u00e9 par le cabinet conservateur sans avoir besoin d\u2019un vote en Chambre.<\/p>","protected":false},"excerpt":{"rendered":"
