Elizabeth May : <\/strong>Monsieur le Pr\u00e9sident, je suis d\u00e9\u00e7ue que l’opposition officielle appuie ce projet de loi tel quel.<\/p>\n

Je l’ai lu attentivement, je l’ai \u00e9tudi\u00e9 et je ne suis toujours pas convaincue qu’il \u00e9tablit un juste \u00e9quilibre dans son approche de la probl\u00e9matique de la non-responsabilit\u00e9 criminelle. Il n’y a actuellement pas la moindre preuve empirique que le syst\u00e8me ne fonctionne pas bien pour les Canadiens.<\/p>\n

J’appuie vigoureusement les dispositions qui permettent aux victimes d’\u00eatre avis\u00e9es \u00e0 l’avance. Je pense n\u00e9anmoins que nous aurions pu mieux tenir compte des int\u00e9r\u00eats et des droits des victimes. D’autre part, il n’\u00e9tait pas n\u00e9cessaire d’inclure, par exemple, la notion de \u00ab nature brutale \u00bb. Cela pourrait maintenant changer compl\u00e8tement la donne pour l’accus\u00e9 \u00e0 haut risque. Si le crime commis entre dans la cat\u00e9gorie des actes de nature brutale, m\u00eame s’il ne provoque pas la mort ou la perp\u00e9tration d’un autre crime grave, la brutalit\u00e9 de l’infraction est cit\u00e9e dans la loi comme raison suffisante pour placer quelqu’un dans la cat\u00e9gorie des accus\u00e9s \u00e0 haut risque.<\/p>\n

Or, la notion de \u00ab nature brutale \u00bb n’a aucune d\u00e9finition en droit p\u00e9nal pas plus qu’elle n’est d\u00e9finie dans le domaine de la sant\u00e9 mentale ou dans les milieux universitaire et scientifique. Par cons\u00e9quent, elle cr\u00e9e \u00e9norm\u00e9ment d’incertitude pour les gens qui pourraient \u00eatre class\u00e9s dans la cat\u00e9gorie des accus\u00e9s \u00e0 haut risque.<\/p>\n

J’invite mon coll\u00e8gue \u00e0 nous parler de cette faiblesse du projet de loi.<\/p>\n

Randall Garrison : <\/strong>Monsieur le Pr\u00e9sident, je suis perplexe quand j’entends la d\u00e9put\u00e9e dire qu’il n’y a aucune preuve empirique montrant qu’il faut faire quelque chose ou aller de l’avant avec ce projet de loi. N’a-t-elle pas entendu la voix des victimes? N’a-t-elle pas vu ce qui est arriv\u00e9 \u00e0 des victimes un peu partout dans notre pays? Je crois qu’il y a en fait une abondance de preuves empiriques.<\/p>\n

Je le dis encore une fois: ce projet de loi aiderait en fait \u00e0 att\u00e9nuer la stigmatisation des personnes souffrant de probl\u00e8mes de sant\u00e9 mentale en mettant dans une cat\u00e9gorie \u00e0 part les tr\u00e8s rares d\u00e9linquants \u00e0 haut risque qui ont commis ce que je qualifierais d’actes tr\u00e8s brutaux. Il n’y a pas moyen de d\u00e9crire une d\u00e9capitation publique autrement qu’en utilisant le mot \u00ab brutal \u00bb. Cela aiderait aussi \u00e0 convaincre le public que nous avons mis en place les mesures voulues pour nous occuper de ces cas, de mani\u00e8re \u00e0 pouvoir ensuite consacrer notre attention aux autres probl\u00e8mes de sant\u00e9 mentale dans la soci\u00e9t\u00e9 sans avoir \u00e0 nous inqui\u00e9ter de ces cas extr\u00eames.
