gar\u00e9 sans surveillance sur la voie principale, sur une pente descendante, et l\u2019immobilisation du train d\u00e9pendait d\u2019une locomotive qui n\u2019\u00e9tait pas en bon \u00e9tat de fonctionnement.<\/li>\n<li>Les 7 freins \u00e0 main qui ont \u00e9t\u00e9 serr\u00e9s pour immobiliser le train n\u2019\u00e9taient pas suffisants pour retenir le train sans l\u2019effort de freinage additionnel fourni par les freins ind\u00e9pendants de locomotive.<\/li>\n<li>L\u2019essai de l\u2019efficacit\u00e9 des freins \u00e0 main n\u2019a pas \u00e9t\u00e9 effectu\u00e9 correctement pour confirmer si l\u2019effort de freinage \u00e9tait suffisant pour emp\u00eacher tout mouvement, et aucun moyen de d\u00e9fense physique additionnel n\u2019\u00e9tait en place pour emp\u00eacher le mouvement involontaire du train.<\/li>\n<li>La formation offerte et la surveillance exerc\u00e9e par la Montreal, Maine &amp; Atlantic Railway n\u2019\u00e9taient pas efficaces pour s\u2019assurer que les membres d\u2019\u00e9quipe comprenaient et respectaient les r\u00e8gles relatives \u00e0 l\u2019immobilisation des trains.<\/li>\n<li>La faible culture de s\u00e9curit\u00e9 de la Montreal, Maine &amp; Atlantic Railway a contribu\u00e9 \u00e0 la perp\u00e9tuation de conditions et de pratiques dangereuses, et a compromis la capacit\u00e9 de la Montreal, Maine &amp; Atlantic Railway de g\u00e9rer efficacement la s\u00e9curit\u00e9.<\/li>\n<li>M\u00eame s\u2019il savait que la Montreal, Maine &amp; Atlantic Railway avait apport\u00e9 des changements op\u00e9rationnels importants, Transports Canada n\u2019a pas exerc\u00e9 une surveillance r\u00e9glementaire ad\u00e9quate pour s\u2019assurer que les risques connexes \u00e9taient bien g\u00e9r\u00e9s.<\/li>\n<li>Le bureau de la r\u00e9gion du Qu\u00e9bec de Transports Canada n\u2019a pas assur\u00e9 un suivi pour veiller \u00e0 ce que les lacunes de s\u00e9curit\u00e9 qui se r\u00e9p\u00e9taient \u00e0 la Montreal, Maine &amp; Atlantic Railway soient analys\u00e9es et corrig\u00e9es efficacement, de sorte que des pratiques dangereuses se sont perp\u00e9tu\u00e9es.<\/li>\n<li>Le nombre et la port\u00e9e limit\u00e9s des v\u00e9rifications des syst\u00e8mes de gestion de la s\u00e9curit\u00e9 effectu\u00e9es par le bureau de la r\u00e9gion du Qu\u00e9bec de Transports Canada, ainsi que l\u2019absence d\u2019une proc\u00e9dure de suivi visant \u00e0 s\u2019assurer que les plans de mesures correctives de la Montreal, Maine &amp; Atlantic Railway avaient \u00e9t\u00e9 mis en oeuvre, ont contribu\u00e9 au fait que des faiblesses syst\u00e9miques du syst\u00e8me de gestio<\/li>\n<\/ul>\n<h2>Faits \u00e9tablis quant aux risques<\/h2>\n<ul>\n<li>S\u2019il n\u2019y a aucune r\u00e8gle ni r\u00e8glement r\u00e9gissant l\u2019exploitation des trains par un seul employ\u00e9, ni aucune exigence selon laquelle Transports Canada approuve et surveille les projets des compagnies ferroviaires \u00e0 cet \u00e9gard, il se pourrait que des trains soient exploit\u00e9s par un seul employ\u00e9 sans que toutes les mesures de d\u00e9fense n\u00e9cessaires soient en place.<\/li>\n<li>Si des analyses ne sont pas effectu\u00e9es de fa\u00e7on syst\u00e9matique sur des \u00e9chantillons repr\u00e9sentatifs de p\u00e9trole brut \u00e0 intervalles appropri\u00e9s, il y a un risque accru que ces marchandises dangereuses seront class\u00e9es incorrectement.<\/li>\n<li>Si elles ne sont pas class\u00e9es et document\u00e9es correctement, les marchandises dangereuses pourraient ne pas \u00eatre transport\u00e9es ou manutentionn\u00e9es convenablement, ce qui augmente le risque que le public subisse des blessures, et que les biens et l\u2019environnement subissent des dommages.<\/li>\n<li>En l\u2019absence d\u2019une surveillance et d\u2019une application efficace de la conformit\u00e9 aux dispositions pertinentes du R\u00e8glement sur le transport des marchandises dangereuses \u00e0 l\u2019\u00e9gard de la classification, il y a un risque que des marchandises dangereuses class\u00e9es incorrectement soient introduites dans le r\u00e9seau de transport.<\/li>\n<li>Si les wagons-citernes de cat\u00e9gorie 111 qui ne sont pas conformes aux normes de protection renforc\u00e9es transportent des liquides inflammables, il y a un risque continu de d\u00e9versement de produit et de dommages importants aux personnes, aux biens et \u00e0 l\u2019environnement lorsque ces wagons sont en cause dans des accidents.<\/li>\n<\/ul>\n<h2>Autres faits \u00e9tablis<\/h2>\n<ul>\n<li>Il n\u2019a pas \u00e9t\u00e9 possible de tirer une conclusion quant \u00e0 savoir si l\u2019exploitation des trains par un seul employ\u00e9 avait contribu\u00e9 \u00e0 l\u2019immobilisation incorrecte du train ou \u00e0 la d\u00e9cision de laisser la locomotive en marche \u00e0 Nantes (Qu\u00e9bec) malgr\u00e9 sa condition anormale.<\/li>\n<li>Le p\u00e9trole brut que le train transportait n\u2019\u00e9tait pas class\u00e9 correctement; il avait \u00e9t\u00e9 affect\u00e9 au groupe d\u2019emballage III (le niveau le moins dangereux) alors qu\u2019il r\u00e9pondait aux crit\u00e8res du
