Ce sont des avocats sp\u00e9cialistes de ce genre de diff\u00e9rends et de la r\u00e9daction de trait\u00e9s. Tous ont insist\u00e9 sur le fait que les entreprises canadiennes ont besoin d&#8217;une telle protection \u00e0 l&#8217;\u00e9tranger et que, dans l&#8217;ensemble, le Canada tire profit de ce genre d&#8217;accords.<\/p>\n<p>Ils ont aussi fait remarquer que tous les dommages et int\u00e9r\u00eats que le Canada a d\u00fb payer jusqu&#8217;\u00e0 maintenant dans l&#8217;affaire AbitibiBowater, qui refl\u00e8tent la valeur des biens saisis ou expropri\u00e9s par le gouvernement de Terre-Neuve-et-Labrador, s&#8217;\u00e9l\u00e8vent \u00e0 environ 20 millions de dollars. Pla\u00e7ons-nous dans un contexte o\u00f9 les investissements \u00e9trangers au Canada s&#8217;\u00e9l\u00e8vent \u00e0 600 milliards de dollars. Vingt millions de dollars, c&#8217;est un trente-milli\u00e8me de cette somme. Selon les experts que j&#8217;ai consult\u00e9s \u00e0 Kingston, c&#8217;est une tr\u00e8s faible portion des montants investis au Canada.<\/p>\n<p>J&#8217;aimerais entendre les observations de ma coll\u00e8gue et ses explications sur l&#8217;opposition manifest\u00e9e par son parti.<\/p>\n<p><strong>Elizabeth May : <\/strong>Monsieur le Pr\u00e9sident, la ferme opposition du Parti vert repose sur des donn\u00e9es empiriques et sur une vaste exp\u00e9rience, notamment sur l&#8217;opinion d&#8217;avocats sp\u00e9cialis\u00e9s en droit international et, en particulier, sur l&#8217;avis du plus grand juriste en mati\u00e8re d&#8217;arbitrage dans ce domaine, et le seul avocat qui ne tire aucun b\u00e9n\u00e9fice des diff\u00e9rends opposant les investisseurs et les \u00c9tats, soit le professeur Gus Van Harten de la facult\u00e9 de droit Osgoode Hall.<\/p>\n<p>Son opinion est \u00e9tay\u00e9e par une \u00e9tude qui a \u00e9t\u00e9 men\u00e9e par un groupe de r\u00e9flexion europ\u00e9en et qui est intitul\u00e9e Les profiteurs de l\u2019injustice; des centaines d&#8217;accords investisseur-\u00c9tat des quatre coins du monde y ont \u00e9t\u00e9 examin\u00e9s et une tendance lourde a \u00e9t\u00e9 d\u00e9cel\u00e9e. Le plus petit acteur \u00e9conomique perd presque toujours, peu importe que ce soit, par exemple, une soci\u00e9t\u00e9 d&#8217;investissements ayant un faible pouvoir \u00e9conomique qui soit oppos\u00e9e \u00e0 un grand \u00c9tat, ou, au contraire, un grand \u00c9tat investisseur qui poursuive un petit pays.<\/p>\n<p>En fait, aucune entreprise am\u00e9ricaine ayant intent\u00e9 une poursuite aux \u00c9tats-Unis au titre du chapitre 11 de l&#8217;ALENA n&#8217;a jamais gagn\u00e9, alors que les entreprises priv\u00e9es am\u00e9ricaines qui poursuivent le Canada ont presque
