Ma question porte sur un sujet sp\u00e9cifique, qui en est peut-\u00eatre un de fond. Il s’agit du fait que toute victime a le droit d’obtenir, sur demande, des renseignements. Il est \u00e9crit, de temps en temps dans le projet de loi, \u00ab sur demande seulement \u00bb. Je pense que ma coll\u00e8gue sait qu’en vertu de la charte des droits des victimes de la Californie, une carte est \u00e9t\u00e9 donn\u00e9e aux victimes, et pas seulement quand elles en font la demande. Que pense ma coll\u00e8gue de cela, particuli\u00e8rement pour am\u00e9liorer les droits des victimes?<\/p>\n

Fran\u00e7oise Boivin :<\/b> Monsieur le Pr\u00e9sident, on met par \u00e9crit des choses qui peuvent \u00eatre demand\u00e9es. Demander est une chose, recevoir en est une autre.<\/p>\n

Je donne un exemple. \u00c0 la page 11 du projet de loi C-32 on dit:<\/p>\n\n\n\n\n
<\/td>\n10. (1) Le paragraphe 278.7(2) de la m\u00eame loi est remplac\u00e9 par ce qui suit:<\/td>\n<\/tr>\n
<\/td>\n(2) Pour d\u00e9cider s\u2019il doit rendre l\u2019ordonnance pr\u00e9vue au paragraphe (1), le juge prend en consid\u00e9ration les effets b\u00e9n\u00e9fiques et pr\u00e9judiciables qu\u2019entra\u00eenera sa d\u00e9cision, d\u2019une part, sur le droit de l\u2019accus\u00e9 \u00e0 une d\u00e9fense pleine et enti\u00e8re et, d\u2019autre part, sur le droit \u00e0 la vie priv\u00e9e et \u00e0 l\u2019\u00e9galit\u00e9 du plaignant ou du t\u00e9moin, selon le cas, et \u00e0 la s\u00e9curit\u00e9 de leur personne, ainsi qu\u2019\u00e0 celui […]<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

On peut demander certaines choses en vertu de la charte, et c’est tr\u00e8s bien. Par contre, beaucoup de b\u00e9mols y sont rattach\u00e9s. Je ne dis pas que c’est mal, je dis simplement au gouvernement d’arr\u00eater de faire semblant que cela r\u00e8gle tous les probl\u00e8mes de la Terre; ce n’est pas vrai. Il n’a pas \u00e0 susciter les attentes des victimes, qui, si elles s’arr\u00eatent aux grands titres dans les m\u00e9dias, penseront que c’est le paradis. Ce ne sera pas le cas, et le retour sur Terre sera brutal.<\/p>\n

C’est tout ce que je dis. il faudrait peut-\u00eatre que le gouvernement change son discours et use d’un ton un peu plus pos\u00e9 pour ne pas continuer \u00e0 faire croire aux victimes des choses qui n’existent pas.<\/p>\n
