{"id":16966,"date":"2016-05-05T11:01:47","date_gmt":"2016-05-05T15:01:47","guid":{"rendered":"http:\/\/elizabethmaymp.ca?p=16966"},"modified":"2016-05-06T12:53:11","modified_gmt":"2016-05-06T16:53:11","slug":"elizabeth-may-introduces-private-members-bill-to-abolish-mandatory-minimums","status":"publish","type":"post","link":"https:\/\/elizabethmaymp.ca\/fr\/elizabeth-may-introduces-private-members-bill-to-abolish-mandatory-minimums\/","title":{"rendered":"Elizabeth May pr\u00e9sente un projet de loi d&#8217;initiative parlementaire pour abolir les peines minimales obligatoires"},"content":{"rendered":"<p><strong>(OTTAWA) Le 5 mai 2016 &#8211;<\/strong> Elizabeth May, chef du Parti vert du Canada (d\u00e9put\u00e9e, Saanich-Gulf Islands), a pr\u00e9sent\u00e9 aujourd&#8217;hui \u00e0 la Chambre des communes un projet de loi d&#8217;initiative parlementaire qui vise \u00e0 abolir les peines minimales obligatoires du syst\u00e8me de justice criminelle.<\/p>\n<p>\u00ab\u00a0Comme nous faisons face \u00e0 une crise de surpopulation et \u00e0 la surrepr\u00e9sentation des prisonniers autochtones et noirs dans nos prisons, nous devons r\u00e9examiner les peines minimales obligatoires et le r\u00f4le qu&#8217;elles jouent dans la perp\u00e9tuation de l&#8217;incarc\u00e9ration excessive et la discrimination syst\u00e9mique, a dit Mme\u00a0May. La Cour supr\u00eame a souvent consid\u00e9r\u00e9 que les peines minimales obligatoires constituaient des &#8216;peines cruelles et inusit\u00e9es&#8217;. Ce projet de loi r\u00e9sultant d\u2019une initiative parlementaire veut r\u00e9soudre la crise induite par les peines minimales obligatoires. On ne peut plus remettre la conversation \u00e0 plus tard.<\/p>\n<p>D&#8217;ailleurs, la Juge en chef Beverley McLachlin a not\u00e9\u00a0: \u201cImplacable, la peine minimale obligatoire est susceptible d\u2019emp\u00eacher le tribunal d\u2019arr\u00eater une peine proportionnelle se situant \u00e0 l\u2019extr\u00e9mit\u00e9 inf\u00e9rieure de la fourchette des sentences possibles\u201d. Aussi, un rapport r\u00e9cent du Bureau de l&#8217;enqu\u00eateur correctionnel indique qu&#8217;entre 2005 et 2015, les populations carc\u00e9rales autochtone et noire ont respectivement augment\u00e9 de 50\u00a0% et 69\u00a0%. Il est donc \u00e9vident qu&#8217;il faut r\u00e9agir \u00e0 cette crise\u00a0\u00bb, a conclu Mme\u00a0May.<\/p>\n<p>Dimitri Lascaris, porte-parole en mati\u00e8re de justice du Parti vert du Canada, a d\u00e9clar\u00e9\u00a0: \u00ab\u00a0Il est inhumain d&#8217;assujettir un large \u00e9ventail de comportements \u00e0 des peines d&#8217;emprisonnement importantes, m\u00eame lorsque les comportements ne m\u00e9ritent pas une sanction s\u00e9v\u00e8re. Les peines minimales obligatoires privent les tribunaux de la discr\u00e9tion qu&#8217;ils doivent avoir pour infliger des peines qui correspondent \u00e0 la gravit\u00e9 des crimes commis. De telles peines sont particuli\u00e8rement inappropri\u00e9es dans les contextes li\u00e9s aux drogues, o\u00f9 une r\u00e9habilitation efficace, et non un emprisonnement prolong\u00e9, est souvent
