Il ne suffit pas de dire qu&#8217;on n&#8217;aime pas le S\u00e9nat et que, par cons\u00e9quent, il faudrait l&#8217;\u00e9liminer.<\/p>\n<p>[27xVnja0ifk]<\/p>\n<p>Sa structure est li\u00e9e \u00e0 la Constitution du Canada. Je crois donc, comme le d\u00e9put\u00e9 de Beaches\u2014East York et son caucus, que le projet de loi C-7, tel qu&#8217;il a \u00e9t\u00e9 pr\u00e9sent\u00e9 par le gouvernement, comporte des failles importantes.<\/p>\n<p>J&#8217;ai eu l&#8217;occasion de travailler avec le S\u00e9nat au fil des ans, et j&#8217;ai vu des situations o\u00f9 le S\u00e9nat a agi de sa propre initiative et a fait de l&#8217;excellent travail; nous avons d&#8217;ailleurs vu des exemples ici ce matin. Je donnerais aussi comme exemple la d\u00e9cision de ne pas mettre d&#8217;hormone de croissance bovine dans le lait. La pr\u00e9sence de cette hormone semblait in\u00e9vitable jusqu&#8217;\u00e0 ce qu&#8217;un comit\u00e9 s\u00e9natorial dirig\u00e9 par les s\u00e9nateurs Mira Spivak et Eugene Whelan assigne des scientifiques de Sant\u00e9 Canada \u00e0 t\u00e9moigner, alors qu&#8217;ils avaient \u00e9t\u00e9 b\u00e2illonn\u00e9s jusque-l\u00e0. C&#8217;est ainsi que l&#8217;information a pu \u00eatre communiqu\u00e9e.<\/p>\n<p>La meilleure fa\u00e7on de proc\u00e9der ne serait-elle pas de tenir une v\u00e9ritable consultation publique sur les probl\u00e8mes fondamentaux qui touchent notre d\u00e9mocratie, ce qui comprend le pouvoir extr\u00eame que d\u00e9tient le cabinet du premier ministre, les limites du r\u00f4le que peuvent jouer les d\u00e9put\u00e9s ordinaires, le juste \u00e9quilibre entre la Chambre des communes et le S\u00e9nat, et le maintien ou l&#8217;abolition du S\u00e9nat?<\/p>\n<p>Le d\u00e9put\u00e9 serait-il d&#8217;accord pour consulter les citoyens avant de faire adopter cette loi?<\/p>\n<p><strong>M. Matthew Kellway:<\/strong> Monsieur le Pr\u00e9sident, la question comporte plusieurs volets et j&#8217;en tiendrai compte.<\/p>\n<p>Le S\u00e9nat a clairement fait du bon travail dans le pass\u00e9. Je pense par exemple \u00e0 un rapport r\u00e9cemment publi\u00e9 sur la pauvret\u00e9 au Canada et aux nombreuses recommandations dignes d&#8217;int\u00e9r\u00eat qu&#8217;il renferme.<\/p>\n<p>Comme mon coll\u00e8gue de Vancouver Kingsway l&#8217;a dit en r\u00e9pondant plus t\u00f4t \u00e0 une question tr\u00e8s semblable, il ne s&#8217;agit pas de savoir si le S\u00e9nat accomplit du bon travail ou si les s\u00e9nateurs ont des opinions valables sur des dossiers qui rev\u00eatent une grande importance pour les Canadiens.<\/p>\n<p>Comme dans bien d&#8217;autres cas, il est possible d&#8217;aborder ce dossier en se penchant sur les questions essentielles. Au d\u00e9but de mon discours, j&#8217;ai parl\u00e9 de quelques principes fondamentaux. Voil\u00e0 l&#8217;objet du d\u00e9bat. Bref, nous avons une chambre dans notre syst\u00e8me parlementaire qui est non d\u00e9mocratique. Le S\u00e9nat peut bloquer un projet de loi adopt\u00e9 par la Chambre des communes, dont les membres sont \u00e9lus. C\u2019est bien ce qui s\u2019est produit avec des projets de loi fort louables.<\/p>\n<p>Je dirais que ce qu&#8217;il convient de faire parfois, c&#8217;est de s&#8217;en tenir aux principes fondamentaux. Si l&#8217;on examine un dossier ainsi, tout devient souvent tr\u00e8s simple.
