Propose: Que la Chambre demande au gouvernement du Canada de r\u00e9pondre de fa\u00e7on prioritaire aux besoins des collectivit\u00e9s des Premi\u00e8res nations dont les membres n\u2019ont pas acc\u00e8s \u00e0 de l\u2019eau courante propre dans leurs maisons; que les mesures visant \u00e0 corriger cette in\u00e9galit\u00e9 soient prises au plus tard au printemps 2012; que la Chambre reconnaisse en outre que le fait de ne pas r\u00e9pondre \u00e0 ce besoin essentiel constitue un outrage constant \u00e0 notre sens de la justice et de l\u2019\u00e9quit\u00e9 en tant que Canadiens.<\/em><\/p><\/blockquote>\n
Mme Cheryl Gallant: Monsieur le Pr\u00e9sident, relativement \u00e0 la question des consultations que la d\u00e9put\u00e9e d’en face vient de soulever, au cours de l’\u00e9t\u00e9 2006, le groupe d’experts a tenu une s\u00e9rie d’audiences publiques aupr\u00e8s des Premi\u00e8res nations partout au Canada. Il a entendu plus de 110 t\u00e9moins et re\u00e7u plus d’une vingtaine de m\u00e9moires.<\/p>\n
En avril 2007, un atelier mixte a eu lieu entre les repr\u00e9sentants f\u00e9d\u00e9raux et le Groupe d’experts techniques sur l’eau de l’Assembl\u00e9e des Premi\u00e8res nations. Il visait \u00e0 entamer une discussion avec les experts techniques au sujet de l\u2019option propos\u00e9e par le gouvernement, \u00e0 savoir l’incorporation par renvoi, et \u00e0 permettre aux experts de relever les probl\u00e8mes et les d\u00e9fis qui devront \u00eatre surmont\u00e9s afin de mettre en \u0153uvre efficacement cette option.<\/p>\n
De mai \u00e0 juillet 2008, AADNC, Sant\u00e9 Canada et Environnement Canada ont rencontr\u00e9 les organisations r\u00e9gionales des Premi\u00e8res nations, l’Assembl\u00e9e des Premi\u00e8res nations et des repr\u00e9sentants des provinces et des territoires, afin de pr\u00e9parer d’autres s\u00e9ances de consultation sur le cadre l\u00e9gislatif. Les Premi\u00e8res nations se sont dites en faveur de la poursuite des discussions entourant l’\u00e9laboration d’une loi et de r\u00e8glements.<\/p>\n
En f\u00e9vrier et en mars 2009, on a tenu des s\u00e9ances de consultation aupr\u00e8s des collectivit\u00e9s des Premi\u00e8res nations, des organisations r\u00e9gionales des Premi\u00e8res nations et des repr\u00e9sentants des provinces et des territoires. Ainsi, les participants ont eu l’occasion de proposer des solutions et de formuler des recommandations sur la meilleure mani\u00e8re de combler les lacunes r\u00e9glementaires qui existent actuellement en mati\u00e8re d’eau potable et d’eaux us\u00e9es dans les collectivit\u00e9s des Premi\u00e8res nations.<\/p>\n
En 2009-2010, le gouvernement f\u00e9d\u00e9ral a rencontr\u00e9 les organisateurs et les chefs des Premi\u00e8res nations afin de discuter des questions r\u00e9gionales particuli\u00e8res qui avaient \u00e9t\u00e9 soulev\u00e9es durant les s\u00e9ances de consultation tenues entre f\u00e9vrier et mars 2009. Durant ces s\u00e9ances, les principaux \u00e9l\u00e9ments du projet de loi ont \u00e9t\u00e9 expos\u00e9s dans une pr\u00e9sentation-diaporama.<\/p>\n
Dans le m\u00eame esprit de collaboration, gr\u00e2ce auquel la d\u00e9put\u00e9e s’est vu attribuer du temps pour prendre part au d\u00e9bat, serait-elle dispos\u00e9e \u00e0 collaborer avec le gouvernement pour aider…<\/p>\n

Mme Elizabeth May:<\/strong> Monsieur le Pr\u00e9sident, il est bien difficile de mener des consultations qui, d’une part, respectent les normes \u00e9tablies par les d\u00e9cisions de la Cour supr\u00eame du Canada, telles que dans les affaires Delgamuukw et Weyerhaeuser et celle mettant en cause la Premi\u00e8re nation Haida Gwaii et qui, d’autre part, pourraient r\u00e9sister \u00e0 d’\u00e9ventuelles contestations.<\/p>\n
Nous pouvons inviter les Premi\u00e8res nations \u00e0 pr\u00e9senter des m\u00e9moires et \u00e0 tenir des r\u00e9unions, mais si les \u00e9changes ne reposaient pas d’embl\u00e9e sur le respect, et certaines de ces r\u00e9unions partaient s\u00fbrement de bonnes intentions et respectaient la norme, il faut se rappeler que ces consultations se font entre deux gouvernements. Il ne s’agit pas simplement de recevoir des m\u00e9moires comme si nous traitions avec des ONG. Dans le cadre du m\u00e9canisme de consultation, on doit d’abord reconna\u00eetre que l’Assembl\u00e9e des Premi\u00e8res Nations est l’entit\u00e9 qui repr\u00e9sente les chefs et les conseils des Premi\u00e8res nations de partout au Canada et les pourparlers entre les deux gouvernements doivent se d\u00e9rouler dans le respect. Cette fa\u00e7on de proc\u00e9der produira de meilleurs r\u00e9sultats.<\/p>\n
