Conform\u00e9ment \u00e0 son attitude positive, il n&#8217;a prononc\u00e9 aucune attaque personnelle contre l&#8217;un ou l&#8217;autre des s\u00e9nateurs, qui sont tous des gens de bonne volont\u00e9.<\/p>\n<p>J&#8217;aimerais \u00e9tayer un peu ses arguments et discuter du projet de loi C-7. Rien ne dit que les s\u00e9nateurs choisis devront obligatoirement figurer dans la liste. D&#8217;apr\u00e8s l&#8217;article 4, le premier ministre \u00ab serait tenu&#8230; de prendre en compte des noms figurant sur la liste \u00bb. Ensuite, au premier paragraphe de l&#8217;annexe, on a une tournure \u00e9trange: \u00ab Les s\u00e9nateurs devant \u00eatre nomm\u00e9s pour une province ou un territoire devraient \u00eatre choisis&#8230; \u00bb.<\/p>\n<p>Quand j&#8217;ai \u00e9tudi\u00e9 le droit, j&#8217;ai appris qu&#8217;il fallait bien faire la distinction entre les mots qui indiquent une possibilit\u00e9 ou une recommandation et ceux qui indiquent une obligation. Je n&#8217;ai encore jamais vu un mot comme \u00ab devrait \u00bb dans une mesure l\u00e9gislative.<\/p>\n<p>Il semble plut\u00f4t illusoire de penser que le gouvernement insisterait pour que les personnes nomm\u00e9es soient choisies \u00e0 partir d&#8217;une liste. Le d\u00e9put\u00e9 pourrait-il commenter ce point?<\/p>\n<p><strong>M. Peter Stoffer:<\/strong> Madame la Pr\u00e9sidente, la d\u00e9put\u00e9e du Parti vert est une Canadienne extraordinaire et elle m\u00e9rite grandement l&#8217;Ordre du Canada qui lui a \u00e9t\u00e9 d\u00e9cern\u00e9.<\/p>\n<p>Depuis longtemps, nous nous int\u00e9ressons tous deux aux conventions collectives. Nous savons donc ce que ces \u00e9nonc\u00e9s flous signifient. Au bout du compte, peu importe ce qui ressortira de tout ceci, seul le premier ministre pourra avoir le dernier mot quant aux personnes qui si\u00e9geront \u00e0 l&#8217;autre endroit. Voil\u00e0 les faits et la v\u00e9rit\u00e9, et les Canadiens doivent le savoir. La marche \u00e0 suivre n&#8217;importe pas. Le processus est un leurre. En fin de compte, une seule personne d\u00e9cide qui si\u00e9gera au S\u00e9nat. Je garantis aux d\u00e9put\u00e9s qu&#8217;il y aura un retour d&#8217;ascenseur pour un tr\u00e8s grand nombre de gens qui ont aid\u00e9 cet
