J&#8217;ai une question au sujet de la r\u00e9alit\u00e9 de ce projet de loi.<\/p>\n<p>Il me semble fascinant que le projet de loi ne cr\u00e9e aucune obligation pour le gouvernement f\u00e9d\u00e9ral, ce qui serait impossible \u00e9videmment, vu les dispositions de la Loi constitutionnelle qui emp\u00eachent le gouvernement f\u00e9d\u00e9ral d&#8217;insister, sans consulter les provinces, pour que les s\u00e9nateurs soient \u00e9lus. Cependant, \u00e0 l&#8217;annexe 1, le projet de loi pr\u00e9voit que les provinces tiendront des \u00e9lections et pr\u00e9pareront une liste qui pourra \u00eatre utilis\u00e9e, mais pas forc\u00e9ment. J&#8217;aimerais entendre les r\u00e9flexions du d\u00e9put\u00e9 sur ce point.<\/p>\n<p><strong>M. Guy Caron:<\/strong> Monsieur le Pr\u00e9sident, je remercie la d\u00e9put\u00e9e de sa question.<\/p>\n<p>Actuellement, le probl\u00e8me majeur est qu&#8217;on aurait un S\u00e9nat dont les membres seraient \u00e9lus ou nomm\u00e9s selon des r\u00e8gles diff\u00e9rentes. Dans certains cas, il y aurait plus de l\u00e9gitimit\u00e9 et les s\u00e9nateurs eux-m\u00eames sentiraient avoir plus de l\u00e9gitimit\u00e9 dans certaines situations. En ce sens, cela cr\u00e9era un S\u00e9nat dysfonctionnel.<\/p>\n<p>Effectivement, ma coll\u00e8gue a raison lorsqu&#8217;elle mentionne que le premier ministre aurait toujours la latitude de ne pas suivre les recommandations issues de ces pl\u00e9biscites. Cela constitue un gros probl\u00e8me. On cr\u00e9e pr\u00e9sentement une esp\u00e8ce d&#8217;hybride, une esp\u00e8ce de monstre et on n&#8217;en conna\u00eetra pas n\u00e9cessairement l&#8217;\u00e9tendue tant qu&#8217;on ne l&#8217;aura pas. Quant \u00e0 nous, ce n&#8217;est pas une exp\u00e9rience qu&#8217;on aimerait tenter.
