{"id":4674,"date":"2012-04-24T08:11:50","date_gmt":"2012-04-24T12:11:50","guid":{"rendered":"http:\/\/elizabethmaymp.ca?p=4674"},"modified":"2012-04-25T08:30:17","modified_gmt":"2012-04-25T12:30:17","slug":"citizens-arrest-and-self-defence-act-bill-c-26-2","status":"publish","type":"post","link":"https:\/\/elizabethmaymp.ca\/fr\/citizens-arrest-and-self-defence-act-bill-c-26-2\/","title":{"rendered":"Loi sur l&#8217;arrestation par des citoyens et la l\u00e9gitime d\u00e9fense (loi C-26)"},"content":{"rendered":"<p><strong>Elizabeth May :<\/strong> Madame la Pr\u00e9sidente, je remercie le d\u00e9put\u00e9 de sa pr\u00e9sentation du projet de loi C-26.<\/p>\n<p>Certains d\u00e9put\u00e9s de la Chambre savent que j&#8217;esp\u00e9rais pr\u00e9senter ce matin un amendement \u00e0 ce projet de loi \u00e0 propos de l&#8217;article qui traite de l&#8217;arrestation par des citoyens et de la nouvelle possibilit\u00e9 de proc\u00e9der \u00e0 l&#8217;arrestation dans un d\u00e9lai raisonnable. Il s&#8217;agit de l&#8217;article 35.3 du projet de loi C-26, qui vise \u00e0 modifier l&#8217;actuel paragraphe 494(2) du Code criminel.<\/p>\n<p>Ma question porte sur ce point pr\u00e9cis. De nombreuses personnes craignent, comme l&#8217;Association du Barreau canadien l&#8217;a tout particuli\u00e8rement soumis au comit\u00e9, que cela ouvre la porte \u00e0 une plus grande pr\u00e9sence des agences de s\u00e9curit\u00e9 priv\u00e9es au lieu de la police et que cela donne aux gens la possibilit\u00e9 de poursuivre quelqu&#8217;un longtemps apr\u00e8s l&#8217;\u00e9v\u00e9nement. Comment le citoyen moyen peut-il savoir ce qu&#8217;est un d\u00e9lai raisonnable? Le projet de loi C-26 pourrait ainsi donner lieu \u00e0 des abus consid\u00e9rables.<\/p>\n<p>J&#8217;aimerais demander au d\u00e9put\u00e9 pourquoi nous n&#8217;avons pas pu supprimer cet article qui ouvre la porte \u00e0 des m\u00e9faits et qui n&#8217;est pas n\u00e9cessaire dans l&#8217;objectif g\u00e9n\u00e9ral de la loi?<\/p>\n<p><strong>Robert Goguen :<\/strong> Madame la Pr\u00e9sidente, je dirai tout d&#8217;abord que le ph\u00e9nom\u00e8ne du justicier a toujours \u00e9t\u00e9 une source de pr\u00e9occupation.<\/p>\n<p>La notion du d\u00e9lai raisonnable vise \u00e0 tenir compte du fait que les policiers ne peuvent pas toujours intervenir rapidement, notamment parce qu&#8217;ils sont d\u00e9j\u00e0 en train de r\u00e9pondre \u00e0 une autre urgence ou parce que l&#8217;incident se produit dans un endroit \u00e9loign\u00e9. Il importe de se rappeler que les policiers demeureront les premiers intervenants lorsqu&#8217;un crime est en cours. Aucune arrestation par un citoyen ne sera jug\u00e9e raisonnable, sauf si celui-ci estimait que les policiers ne seraient pas en mesure d&#8217;intervenir \u00e0 temps.<\/p>\n<p>Comme je l&#8217;ai dit un peu plus t\u00f4t, nous avons sans doute le meilleur syst\u00e8me judiciaire du monde.
