{"id":5432,"date":"2012-06-04T15:57:50","date_gmt":"2012-06-04T19:57:50","guid":{"rendered":"http:\/\/elizabethmaymp.ca?p=5432"},"modified":"2012-06-04T15:57:50","modified_gmt":"2012-06-04T19:57:50","slug":"may-rises-on-bill-c-38-point-of-order","status":"publish","type":"post","link":"https:\/\/elizabethmaymp.ca\/fr\/may-rises-on-bill-c-38-point-of-order\/","title":{"rendered":"May invoque le R\u00e8glement sur le projet de loi C38"},"content":{"rendered":"<p>La chef du Parti vert du Canada et d\u00e9put\u00e9e de Saanich-Gulf Islands Elizabeth May a invoqu\u00e9 le R\u00e8glement aujourd\u2019hui en Chambre en lien avec le projet de loi C38 en se basant sur le r\u00e8glement 68(3), qui stipule qu\u2019aucun projet de loi ne peut \u00eatre pr\u00e9sent\u00e9 en blanc ou dans une forme incompl\u00e8te.<\/p>\n<p>\u00ab Je veux faire admettre que ce projet de loi n\u2019a pas \u00e9t\u00e9 pr\u00e9sent\u00e9 dans une forme ad\u00e9quate et que, \u00e0 ce titre, il est &#8220;incomplet&#8221; et doit \u00eatre rejet\u00e9. \u00bb<\/p>\n<p>\u00ab De toute \u00e9vidence, le pr\u00e9sident a le pouvoir de d\u00e9terminer si une mesure l\u00e9gislative, qui pr\u00e9tend \u00eatre un projet de loi omnibus, est pr\u00e9sent\u00e9e dans une forme ad\u00e9quate, qui r\u00e9pond aux crit\u00e8res d\u2019un projet de loi omnibus. Les crit\u00e8res sont tr\u00e8s clairs. Un projet de loi omnibus doit avoir un seul &#8220;principe de base&#8221; ou &#8220;objet fondamental&#8221;. \u00bb<\/p>\n<p>Le projet de loi C38 est donc pr\u00e9sent\u00e9 dans une forme \u00ab incompl\u00e8te \u00bb. Il a \u00e9chou\u00e9 au test et ne r\u00e9pond pas aux crit\u00e8res d\u2019un vrai projet de loi omnibus :<\/p>\n<ol>\n<li>Il a \u00e9chou\u00e9 parce qu\u2019il n\u2019a pas de th\u00e8me central, ce \u00ab principe de base \u00bb ou \u00ab objet fondamental \u00bb, qui permettrait de justifier sa forme aux fins de d\u00e9bat ou d\u2019examen;<\/li>\n<li>Il a \u00e9chou\u00e9 parce qu\u2019il n\u2019\u00e9tablit pas de lien entre les diff\u00e9rents \u00e9l\u00e9ments du projet de loi C38 et le budget;<\/li>\n<li>Il a \u00e9chou\u00e9 parce qu\u2019il omet des actions ainsi que des changements r\u00e9glementaires et l\u00e9gislatifs d\u00e9crits par les repr\u00e9sentants du Conseil priv\u00e9 comme faisant partie du projet de loi C38. L\u2019omission d\u2019\u00e9l\u00e9ments, que les ministres et les honorables membres du Conseil priv\u00e9 affirment font partie du projet de loi C38, confirment que le projet de loi est pr\u00e9sent\u00e9 dans une forme incompl\u00e8te, qu\u2019il n\u2019est pas pr\u00eat et qu\u2019il doit \u00eatre remani\u00e9.<\/li>\n<\/ol>\n<p>\u00ab En conclusion, Monsieur le Pr\u00e9sident, je souhaite mettre de l\u2019avant un ultime argument pour vous convaincre de rejeter le projet de loi C38 comme contrevenant au R\u00e8glement de cette Chambre. Le voici : il met en p\u00e9ril le respect de la personne morale de cette institution \u00bb, a dit May.<\/p>\n<p>\u00ab Permettre au projet de loi C38 de passer pour un projet de loi omnibus minera encore plus l\u2019int\u00e9grit\u00e9 de nos institutions. Les principaux m\u00e9dias consid\u00e8rent le projet de loi C38 comme la tromperie du si\u00e8cle. \u00bb<\/p>\n<p>L\u2019Opposition officielle et le Parti lib\u00e9ral ont demand\u00e9 l\u2019autorisation d\u2019\u00e9tudier le rappel au R\u00e8glement du Parti vert du Canada et de pr\u00e9senter leurs propres arguments. Le pr\u00e9sident de la Chambre \u00e9tudiera les arguments pr\u00e9sent\u00e9s et rendra sa d\u00e9cision dans un avenir rapproch\u00e9.<\/p>","protected":false},"excerpt":{"rendered":"<p>La chef du
