{"id":5580,"date":"2012-06-07T11:46:36","date_gmt":"2012-06-07T15:46:36","guid":{"rendered":"http:\/\/elizabethmaymp.ca?p=5580"},"modified":"2012-06-08T11:59:06","modified_gmt":"2012-06-08T15:59:06","slug":"points-of-order-bill-c-38-2","status":"publish","type":"post","link":"https:\/\/elizabethmaymp.ca\/fr\/points-of-order-bill-c-38-2\/","title":{"rendered":"Recours au R\u00e8glement &#8211; le projet de loi C-38"},"content":{"rendered":"<p><strong>Marc Garneau :<\/strong> Monsieur le Pr\u00e9sident, je voudrais r\u00e9pondre au recours <a href=\"http:\/\/elizabethmaymp.ca\/fr\/parliament\/points-of-order\/2012\/06\/04\/points-of-order-bill-c-38\/\">au R\u00e8glement effectu\u00e9 cette semaine par la d\u00e9put\u00e9e de Saanich\u2014Gulf Islands<\/a>, concernant le projet de loi C-38.<\/p>\n<p>Je tiens \u00e0 r\u00e9p\u00e9ter que le Parti lib\u00e9ral s&#8217;inqui\u00e8te lui aussi beaucoup de ce projet de loi. Il est fourbe et trompeur \u00e0 l&#8217;extr\u00eame de la part du gouvernement de justifier le projet de loi dans sa forme actuelle en invoquant la n\u00e9cessit\u00e9 de stimuler notre \u00e9conomie fragile.<\/p>\n<p>Par exemple, la d\u00e9cision du gouvernement de faire passer de 65 \u00e0 67 ans l&#8217;\u00e2ge d&#8217;admissibilit\u00e9 \u00e0 la S\u00e9curit\u00e9 de la vieillesse \u00e0 compter de 2023 peut difficilement \u00eatre consid\u00e9r\u00e9e comme une d\u00e9cision budg\u00e9taire cruciale, qui doit \u00eatre prise maintenant et dans ce projet de loi. La plupart d&#8217;entre nous ne seront peut-\u00eatre m\u00eame plus ici dans 11 ans.<\/p>\n<p>Tous les changements qui affectent les lois touchant l&#8217;environnement et les p\u00eacheries constituent un autre exemple. Comment peut-on pr\u00e9tendre que ces changements doivent \u00eatre adopt\u00e9s imm\u00e9diatement, afin de prot\u00e9ger notre \u00e9conomie fragile? Ces lois auront des r\u00e9percussions profondes et doivent \u00eatre d\u00e9battues dans des projets de loi qui leur sont propres.<\/p>\n<p>Ce qui s&#8217;est produit dans le cas du projet de loi C-38 est assez \u00e9tonnant. Ce m\u00e9gaprojet de loi budg\u00e9taire d\u00e9sormais tristement c\u00e9l\u00e8bre suscite l&#8217;indignation d&#8217;un bout \u00e0 l&#8217;autre du pays, et les observations de la d\u00e9put\u00e9e de Saanich\u2014Gulf Islands refl\u00e8tent certainement les craintes exprim\u00e9es par les Canadiens. Aucun fil conducteur ne relie les \u00e9l\u00e9ments de ce projet de loi massif. Qui plus est, m\u00eame en faisant preuve d&#8217;une tr\u00e8s forte dose d&#8217;imagination, on ne peut attribuer \u00e0 certains \u00e9l\u00e9ments aucune nature budg\u00e9taire. Donc, le projet de loi C-38 n&#8217;est pas vraiment un projet de loi omnibus.<\/p>\n<p>Nous savons que les projets de loi budg\u00e9taires peuvent s&#8217;av\u00e9rer volumineux, mais force est de constater que ce gouvernement a red\u00e9fini le terme \u00ab omnibus \u00bb en l&#8217;amenant \u00e0 un niveau sans pr\u00e9c\u00e9dent.<\/p>\n<p>Le leader du gouvernement \u00e0 la Chambre a beau affirmer que ce projet de loi comporte un fil conducteur, celui du budget, mais qu&#8217;on me permette d&#8217;\u00eatre en d\u00e9saccord. On ne peut se servir du budget comme bouclier permettant de tout introduire, incluant l&#8217;\u00e9vier de la cuisine.<\/p>\n<p>Prenons, par exemple, le cas de l&#8217;article 52 du projet de loi. Il \u00e9dicte \u00e0 lui seul une loi totalement nouvelle, la Loi canadienne sur l\u2019\u00e9valuation environnementale (2012). Or, l&#8217;article 52 n&#8217;est que l&#8217;un des 753 articles du projet de loi, et il a \u00e9t\u00e9 \u00e9tudi\u00e9 pendant seulement 15 minutes par le comit\u00e9.<\/p>\n<p>Les r\u00e8gles et les pratiques concernant les projets de loi omnibus ont une raison d&#8217;\u00eatre. Comment les d\u00e9put\u00e9s peuvent-ils \u00e9tudier ad\u00e9quatement un tel projet de loi lorsque son contenu est si vaste et si disparate? Si j&#8217;ose dire, c&#8217;est peut-\u00eatre exactement ce que souhaitent les d\u00e9put\u00e9s d&#8217;en face.<\/p>\n<p>Je dois souligner \u00e0 grands traits que ce projet de loi est con\u00e7u pour \u00eatre pratiquement impossible \u00e0 \u00e9tudier ad\u00e9quatement. Un projet de loi budg\u00e9taire contenant des mesures sur les finances et la fiscalit\u00e9 est une chose. Mais le salmigondis d&#8217;articles ayant une incidence sur plus de 60 lois f\u00e9d\u00e9rales qui nous est soumis constitue une proposition compl\u00e8tement diff\u00e9rente.\u00a0<\/p>\n<p>En conclusion, je souhaite ardemment que ce gouvernement scinde ce projet de loi en plusieurs parties car, en fin de compte, les Canadiens et Canadiennes veulent que plusieurs \u00e9l\u00e9ments du projet de loi C-38 soient trait\u00e9es s\u00e9par\u00e9ment.
