Sommaire<\/strong><\/p>\n

Le texte modifie la partie 9 de la Loi de 2001 sur la marine marchande du Canada afin d\u2019interdire le transport de p\u00e9trole par p\u00e9trolier dans les r\u00e9gions de la mer adjacentes \u00e0 la c\u00f4te canadienne connues sous les noms d\u2019entr\u00e9e Dixon, de d\u00e9troit de H\u00e9cate et de bassin Reine-Charlotte.<\/p>\n

Attendu que le transport de p\u00e9trole par p\u00e9trolier dans certaines r\u00e9gions de la mer adjacentes \u00e0 la c\u00f4te canadienne pose un risque pour le milieu marin, Sa Majest\u00e9, sur l\u2019avis et avec le consentement du S\u00e9nat et de la Chambre des communes du Canada, \u00e9dicte : 2001, ch. 26<\/p>\n

Loi de 2001 sur la marine marchande du Canada<\/strong><\/p>\n

1. La Loi de 2001 sur la marine marchande du Canada est modifi\u00e9e par adjonction, apr\u00e8s l\u2019article 189, de ce qui suit :<\/p>\n

Interdiction D\u00e9finitions<\/p>\n

189.1 Les d\u00e9finitions qui suivent s’appliquent aux articles 189.2 et 189.3.<\/p>\n

\u00ab en vrac \u00bb Dans une cale ou une citerne faisant partie de la structure du b\u00e2timent, sans contenant interm\u00e9diaire.<\/p>\n

\u00ab p\u00e9trole \u00bb S’entend au sens de l’article 2 de la Loi sur les op\u00e9rations p\u00e9troli\u00e8res au Canada.<\/p>\n

\u00ab p\u00e9trolier \u00bb B\u00e2timent construit ou adapt\u00e9 principalement en vue de transporter du p\u00e9trole en vrac.<\/p>\n

R\u00e9gions interdites<\/p>\n

189.2 (1) Il est interdit de transporter du p\u00e9trole par p\u00e9trolier dans les r\u00e9gions de la mer adjacentes \u00e0 la c\u00f4te canadienne connues sous les noms d\u2019entr\u00e9e Dixon, de d\u00e9troit de H\u00e9cate et de bassin Reine-Charlotte.<\/p>\n

Pr\u00e9cision<\/p>\n

(2) Les r\u00e9gions de la mer vis\u00e9es au paragraphe (1) sont celles d\u00e9crites dans la zone 3 du D\u00e9cret sur les zones de p\u00eache du Canada (zones 1, 2 et 3) pris en vertu de la Loi sur les oc\u00e9ans.<\/p>\n

Pr\u00e9cision<\/p>\n

(3) Il est entendu que l\u2019interdiction \u00e9nonc\u00e9e au paragraphe (1) ne s\u2019applique pas au transport d\u2019essence, de carburant aviation, de carburant-diesel ou de tout autre carburant destin\u00e9 \u00e0 l\u2019usage des collectivit\u00e9s de la c\u00f4te et des \u00eeles canadiennes.<\/p>\n

2. Le paragraphe 191(1) de la m\u00eame loi est modifi\u00e9 par adjonction, apr\u00e8s l’alin\u00e9a c), de ce qui suit :<\/p>\n

c.1) \u00e0 l\u2019article 189.2 (interdiction d\u2019exploiter un p\u00e9trolier dans une r\u00e9gion interdite);<\/p>\n

c.2) \u00e0 un d\u00e9cret pris en vertu de l’article 189.3 (interdiction d’exploiter un p\u00e9trolier dans une r\u00e9gion interdite);<\/p>\n

Entr\u00e9e en vigueur<\/strong><\/p>\n
