{"id":7682,"date":"2012-11-21T12:27:04","date_gmt":"2012-11-21T17:27:04","guid":{"rendered":"http:\/\/elizabethmaymp.ca?p=7682"},"modified":"2012-11-22T12:42:15","modified_gmt":"2012-11-22T17:42:15","slug":"nafta-lawsuit-should-be-an-eye-opener-for-harper","status":"publish","type":"post","link":"https:\/\/elizabethmaymp.ca\/fr\/nafta-lawsuit-should-be-an-eye-opener-for-harper\/","title":{"rendered":"Une poursuite en forme de signal d&#8217;alarme pour Harper"},"content":{"rendered":"<p>Nous avons appris le 15 novembre dernier que la compagnie Lone Pine Resources, bas\u00e9e aux \u00c9tats-Unis, allait poursuivre le gouvernement canadien en vertu du tristement c\u00e9l\u00e8bre Chapitre 11 de l\u2019AL\u00c9NA. L\u2019objet de cette poursuite ? La d\u00e9cision du Qu\u00e9bec d\u2019imposer un moratoire sur l&#8217;exploration et l&#8217;exploitation p\u00e9troli\u00e8re et gazi\u00e8re dans l&#8217;estuaire du Saint-Laurent. Lone Pine exige maintenant une \u00abcompensation\u00bbde 250 millions de dollars.<\/p>\n<p>En annon\u00e7ant son moratoire, le Qu\u00e9bec a non seulement pris une bonne d\u00e9cision (le Parti vert est le seul parti f\u00e9d\u00e9ral a demander un moratoire sur toute exploitation ou exploration p\u00e9troli\u00e8re\/gazi\u00e8re dans le golfe), mais il a pav\u00e9 la voie \u00e0 toutes les autres provinces. Cette d\u00e9cision a \u00e9t\u00e9 prise par des \u00e9lus avec l\u2019appui massif des citoyens qui n\u2019avaient pas oubli\u00e9 la catastrophe de la plate-forme p\u00e9troli\u00e8re <em>Deepwater Horizon<\/em> dans le golfe du Mexique. Lone Pine qualifie la d\u00e9cision du Qu\u00e9bec d\u2019 \u00abarbitraire\u00bb. C\u2019est tout le contraire.<\/p>\n<p>Cet exemple de poursuite absurde devrait \u00eatre un signal d\u2019alarme pour les Conservateurs de Stephen Harper qui n\u2019en ont que pour le Trait\u00e9 Canada-Chine sur les investissements. <a href=\"https:\/\/www.greenparty.ca\/fr\/media-release\/2012-11-01\/avertissement-de-la-chef-des-verts-au-pm-harper-quant-la-possible-ratificat\" target=\"_blank\">Gr\u00e2ce \u00e0 l\u2019action de citoyens comme vous, ce trait\u00e9 n\u2019a pas encore \u00e9t\u00e9 ratifi\u00e9<\/a>. S\u2019il l\u2019\u00e9tait, il permettrait aux entreprises de la Chine (incluant les soci\u00e9t\u00e9s d\u2019\u00c9tat) de poursuivre le Canada pour des d\u00e9cisions <strong>limitant ou r\u00e9duisant leurs pr\u00e9visions de profits<\/strong>. La Chine pourrait poursuivre le Canada pour des d\u00e9cisions de tous les paliers de gouvernement : municipal, provincial, territorial et f\u00e9d\u00e9ral. M\u00eame les d\u00e9cisions des cours pourraient \u00eatre attaqu\u00e9es.<\/p>\n<p>Tout cela n\u2019est pas th\u00e9orique : le path\u00e9tique cas de Lone Pine nous montre comment une compagnie des \u00c9tats-Unis peut maintenant nous poursuivre. Imaginez ce que ce serait si Stephen Harper donnait le m\u00eame genre de pouvoir \u00e0 des entreprises contr\u00f4l\u00e9es par le Parti communiste chinois.<\/p>\n<p>Je sais que vous avez d\u00e9j\u00e0 pris part \u00e0 notre campagne contre ce trait\u00e9.
