Projet de loi C-37 : Loi modifiant le Code criminel<\/em><\/p>\n

Motion no 1<\/strong> \u2014 5 d\u00e9cembre 2012 \u2014 Mme May (Saanich\u2014Gulf Islands) \u2014 Que le projet de loi C-37, \u00e0 l’article 3, soit modifi\u00e9 par adjonction, apr\u00e8s la ligne 26, page 1, de ce qui suit :<\/p>\n

\u00ab (1.1) Le juge peut, sur demande du contrevenant, surseoir \u00e0 la perception imm\u00e9diate de la suramende compensatoire impos\u00e9e au titre du paragraphe (1) si le contrevenant fait la preuve, selon le cas :<\/p>\n

a) qu’il est incapable de payer sans d\u00e9lai la suramende en raison de sa pauvret\u00e9;
\nb) que le paiement sans d\u00e9lai de la suramende nuirait \u00e0 sa r\u00e9adaptation;
\nc) qu’il est incapable de payer sans d\u00e9lai la suramende et n’a pas acc\u00e8s au programme de paiement facultatif de l’amende vis\u00e9 \u00e0 l’article 736 ou \u00e0 un programme semblable.<\/p>\n

(1.2) Dans sa d\u00e9cision de surseoir \u00e0 la perception imm\u00e9diate de la suramende compensatoire en vertu du paragraphe (1.1), le juge peut tenir compte du fait que le contrevenant est membre d’une premi\u00e8re nation. \u00bb<\/p>\n
