{"id":8799,"date":"2013-03-01T13:54:15","date_gmt":"2013-03-01T18:54:15","guid":{"rendered":"http:\/\/elizabethmaymp.ca?p=8799"},"modified":"2013-03-06T14:08:32","modified_gmt":"2013-03-06T19:08:32","slug":"not-criminally-responsible-reform-act-bill-c-54-2","status":"publish","type":"post","link":"https:\/\/elizabethmaymp.ca\/fr\/not-criminally-responsible-reform-act-bill-c-54-2\/","title":{"rendered":"Loi sur la r\u00e9forme de la non-responsabilit\u00e9 criminelle (projet de loi C-54)"},"content":{"rendered":"<p><strong>Elizabeth May\u00a0<\/strong><strong>:\u00a0<\/strong>Monsieur le Pr\u00e9sident, je remercie le d\u00e9put\u00e9 de Mont-Royal de son intervention et, bien entendu, je lui sais gr\u00e9 de nous faire profiter de son exp\u00e9rience particuli\u00e8re puisque c&#8217;est lui, lorsqu&#8217;il \u00e9tait ministre de la Justice, qui a institu\u00e9 le cadre l\u00e9gislatif applicable \u00e0 la non-responsabilit\u00e9 criminelle, il y a huit ans.<\/p>\n<p>Bien s\u00fbr, on con\u00e7oit difficilement un cas de figure o\u00f9 nous disposerions des donn\u00e9es n\u00e9cessaires pour analyser la situation. Cependant, j&#8217;ai instinctivement l&#8217;impression que, si c&#8217;\u00e9tait le cas, nous constaterions que le probl\u00e8me d\u00e9coule essentiellement de notre incapacit\u00e9 \u00e0 adopter, dans toutes les sph\u00e8res de la soci\u00e9t\u00e9, une approche globale par rapport \u00e0 la sant\u00e9 mentale, de mani\u00e8re \u00e0 pr\u00e9venir les actes et les crimes violents que commettent une toute petite minorit\u00e9 de personnes atteintes de troubles mentaux. Apr\u00e8s tout, nous savons que seule une infime minorit\u00e9 de toutes ces personnes sont impliqu\u00e9es dans des situations semblables, m\u00eame si les cons\u00e9quences sont d\u00e9sastreuses lorsque cela survient.<\/p>\n<p>Tout cela ne donne-t-il pas \u00e0 penser qu&#8217;il serait plus logique de se concentrer sur la pr\u00e9vention de ces situations rarissimes au lieu de chercher \u00e0 garder ind\u00e9finiment quelques personnes derri\u00e8re les barreaux et \u00e0 trouver des failles \u00e0 un syst\u00e8me dont rien ne laisse supposer qu&#8217;il soit d\u00e9ficient?<\/p>\n<p><strong>Irwin Cotle<\/strong>r : Monsieur le Pr\u00e9sident, je suis d&#8217;accord. Le projet de loi s&#8217;attaque au probl\u00e8me dans une optique de ch\u00e2timent plut\u00f4t que dans une optique de pr\u00e9vention, une fa\u00e7on de faire qui semble malheureusement devenir la norme. Puisqu&#8217;on parle ici de personnes atteintes de troubles mentaux, la pr\u00e9vention est essentielle.<\/p>\n<p>Il est regrettable que les amendements que j&#8217;ai propos\u00e9s pour le projet de loi C-10 afin de favoriser le traitement des d\u00e9linquants atteints de maladie mentale plut\u00f4t que leur incarc\u00e9ration et la pr\u00e9vention de la criminalit\u00e9 plut\u00f4t que le ch\u00e2timent aient \u00e9t\u00e9 rejet\u00e9s par le gouvernement, et ce, m\u00eame s&#8217;ils n&#8217;avaient pour seul but que d&#8217;am\u00e9liorer et de prot\u00e9ger la s\u00e9curit\u00e9 publique, les raisons m\u00eames invoqu\u00e9es ostensiblement par le gouvernement pour justifier le projet de loi C-10.<\/p>\n<p>La pr\u00e9vention \u00e9liminerait en fait le besoin de prot\u00e9ger la s\u00e9curit\u00e9 publique: elle r\u00e9duirait le nombre de victimes, traiterait mieux les d\u00e9linquants dans une optique de r\u00e9insertion sociale, et traiterait de fa\u00e7on appropri\u00e9e les personnes qui ne sont pas consid\u00e9r\u00e9es comme \u00e9tant des d\u00e9linquants et qui ne sont pas r\u00e9put\u00e9es criminellement responsables, en particulier dans le
