{"id":8911,"date":"2013-03-14T13:22:21","date_gmt":"2013-03-14T17:22:21","guid":{"rendered":"http:\/\/elizabethmaymp.ca?p=8911"},"modified":"2013-03-14T13:22:21","modified_gmt":"2013-03-14T17:22:21","slug":"canada-should-take-good-note-of-indias-freeze-on-all-investment-protection-agreements","status":"publish","type":"post","link":"https:\/\/elizabethmaymp.ca\/fr\/canada-should-take-good-note-of-indias-freeze-on-all-investment-protection-agreements\/","title":{"rendered":"\u00ab Le Canada devrait prendre bonne note du moratoire de l\u2019Inde sur les trait\u00e9s de protection des investissements \u00bb"},"content":{"rendered":"<p>Avec la ratification du <a href=\"https:\/\/www.greenparty.ca\/fr\/stop-the-sellout\" target=\"_blank\" rel=\"noopener noreferrer\">Trait\u00e9 Canada-Chine sur les investissements<\/a> toujours en suspens, le Parti vert du Canada souligne la remise en question par l\u2019Inde des trait\u00e9s bilat\u00e9raux de protection des investissements et leur m\u00e9canisme de r\u00e8glement des diff\u00e9rends investisseur\/\u00c9tat.<\/p>\n<p>Apr\u00e8s avoir subie des menaces de recours \u00e0 l\u2019arbitrage international de la part de compagnies \u00e9trang\u00e8res, l\u2019Inde a impos\u00e9 un moratoire sur les n\u00e9gociations d\u2019accords bilat\u00e9raux de protection des investissements jusqu\u2019\u00e0 ce qu\u2019un processus d\u2019examen gouvernemental soit compl\u00e9t\u00e9. M\u00eame si la d\u00e9cision indienne n\u2019a pas \u00e9t\u00e9 relev\u00e9e dans les m\u00e9dias canadiens, elle n\u2019en demeure pas moins pertinente.<\/p>\n<p>\u00ab En novembre 2012, le premier ministre Harper <a href=\"http:\/\/www.parl.gc.ca\/HousePublications\/Publication.aspx?Language=E&amp;Mode=1&amp;Parl=41&amp;Ses=1&amp;DocId=5852794#SOB-7792628\" target=\"_blank\" rel=\"noopener noreferrer\">m\u2019a affirm\u00e9 en Chambre<\/a> que son homologue indien \u00e9tait d\u00e9termin\u00e9 \u00e0 signer avec le Canada un accord de protection et de promotion des investissements \u00e9trangers. Je pense que le Canada devrait prendre bonne note du moratoire de l\u2019Inde sur les trait\u00e9s de protection des investissements \u00bb, a d\u00e9clar\u00e9 la chef du Parti vert du Canada et d\u00e9put\u00e9e de Saanich-Gulf Islands, Mme Elizabeth\u00a0May.<\/p>\n<p>\u00ab Le m\u00e9canisme de r\u00e8glement des diff\u00e9rends investisseur\/\u00c9tat contenu dans ces accords permet \u00e0 des compagnies \u00e9trang\u00e8res de poursuivre le Canada hors des cours de justice canadiennes. Des arbitres sp\u00e9ciaux seront appel\u00e9s \u00e0 trancher les litiges et leurs d\u00e9cisions ne pourront faire l\u2019objet d\u2019une r\u00e9vision judiciaire. De plus, ces arbitrages seront secrets. En fait, l&#8217;existence m\u00eame d&#8217;un d&#8217;arbitrage en cours sera tenue secr\u00e8te \u00bb a d\u00e9clar\u00e9 Mme May.<\/p>\n<p>\u00ab L\u2019Inde embo\u00eete le pas \u00e0 des pays comme l\u2019Australie et l\u2019Afrique du Sud o\u00f9 l\u2019on s\u2019est ravis\u00e9 quant aux clauses d\u2019arbitrage investisseur\/\u00c9tat. Il est temps pour le Canada de tourner la page sur une vision du commerce international antid\u00e9mocratique et d\u00e9pass\u00e9e \u00bb, a d\u00e9clar\u00e9 Mme
