Cette d\u00e9finition est certes employ\u00e9e ailleurs dans le Code criminel, mais dans ce cas pr\u00e9cis, o\u00f9 on constate une ing\u00e9rence consid\u00e9rable de l&#8217;\u00c9tat dans la vie priv\u00e9e des Canadiens, il s&#8217;agit de pr\u00e9ciser que ces mesures ne peuvent pas \u00eatre prises par tout un chacun, et ce, m\u00eame dans les services de police, car, comme l&#8217;a \u00e9crit l&#8217;Association du Barreau canadien dans sa lettre adress\u00e9e au comit\u00e9, \u00ab [u]ne formation sp\u00e9ciale et une surveillance sont n\u00e9cessaires pour les agents de police qui d\u00e9tiennent des pouvoirs potentiellement si intrusifs. \u00bb<\/p>\n<p>Il faut essentiellement comprendre que ce n&#8217;est peut-\u00eatre pas le policier en patrouille qui pourra faire de l&#8217;\u00e9coute \u00e9lectronique sans mandat en situation d&#8217;urgence. Par ailleurs, ces m\u00eames personnes devraient \u00eatre en mesure de conserver leurs notes. Elles ont seulement besoin de noter \u00e0 la main les motifs valables qui justifiaient, selon elles, le recours \u00e0 ce pouvoir extraordinaire, qui leur permet de s&#8217;immiscer dans la vie
