N\u00e9anmoins, il reste des questions profondes concernant ce projet de loi.<\/p>\n<p>Ma coll\u00e8gue serait-elle d&#8217;accord avec moi pour dire que le projet de loi serait am\u00e9lior\u00e9 gr\u00e2ce aux changements apport\u00e9s par les amendements aujourd&#8217;hui?<\/p>\n<p><strong>Fran\u00e7oise Boivin<\/strong>: Monsieur le Pr\u00e9sident, je r\u00e9pondrai \u00e0 la question de la fa\u00e7on suivante.<\/p>\n<p>Par exemple, lorsqu&#8217;on \u00e9tudiait la d\u00e9finition de policier ou qu&#8217;on s&#8217;interrogeait sur le contenu des rapports, on comprenait que tout un volet est provincial. Donc, je pense qu&#8217;il faut nous concentrer sur la r\u00e9ponse \u00e0 donner aux diktats de la Cour supr\u00eame du Canada.<\/p>\n<p>Cela ne veut pas dire que nous ne pourrons pas faire une \u00e9tude plus approfondie des autres volets, mais ils soul\u00e8vent d&#8217;autres probl\u00e8mes. Or dans ma t\u00eate, je n&#8217;ai pas une r\u00e9ponse claire, nette et pr\u00e9cise voulant que, par l&#8217;amendement, on ne cr\u00e9e pas des situations probl\u00e9matiques au lieu d&#8217;en r\u00e9gler. C&#8217;est ce que ce type d&#8217;amendements soulevait.<\/p>\n<p>Dans le contexte de la d\u00e9cision R. c. Tse, il est pr\u00e9f\u00e9rable de laisser le texte tel quel. Apr\u00e8s coup, il y aura peut-\u00eatre d&#8217;autres d\u00e9marches \u00e0 entamer en mati\u00e8re d&#8217;\u00e9coute \u00e9lectronique ou d&#8217;interception. Cependant, en fonction de l&#8217;arr\u00eat R. c. Tse, la r\u00e9ponse est plus qu&#8217;appropri\u00e9e.<\/p>\n<p>Il reste des interrogations quant au fait de fermer la d\u00e9finition \u00e0 \u00ab policier \u00bb, de la fa\u00e7on dont ma coll\u00e8gue veut le faire. Des t\u00e9moins nous disaient que cela entra\u00eenait certaines difficult\u00e9s. \u00c0 certains endroits, on ne d\u00e9crit peut-\u00eatre pas la r\u00e9alit\u00e9 de la m\u00eame fa\u00e7on, mais on interpr\u00e8te d\u00e9j\u00e0 bien cette autre personne qui s&#8217;occupe du maintien de la paix.<\/p>\n<p>Pour ce qui est du temps limit\u00e9, je pense qu&#8217;il reviendra au gouvernement d&#8217;en porter l&#8217;odieux, car c&#8217;est lui qui force ce type d&#8217;exercice devant se faire \u00e0 tr\u00e8s grande vitesse. Cela dit, la seule question que la Chambre doit se poser, c&#8217;est de savoir si cela r\u00e9pond au principe demand\u00e9 par la Cour supr\u00eame. La r\u00e9ponse est simplement: oui.
