J&#8217;attire l&#8217;attention sur la d\u00e9claration suivante de Kent Roach, professeur de droit \u00e0 l&#8217;Universit\u00e9 de Toronto:<\/p>\n<blockquote><p>J&#8217;estime que c&#8217;est toujours probl\u00e9matique, dans une d\u00e9mocratie, lorsqu&#8217;on s&#8217;ing\u00e8re dans le pouvoir de la police de d\u00e9cider d&#8217;entamer ou de mener une enqu\u00eate.<\/p><\/blockquote>\n<p>Michel Drapeau, un avocat comptant 34 ann\u00e9es d&#8217;exp\u00e9rience aupr\u00e8s du secteur militaire canadien a dit:<\/p>\n<blockquote><p>Est-ce que le maire pourrait donner des directives au chef de la police d&#8217;Ottawa, m\u00eame par \u00e9crit, au sujet d&#8217;une enqu\u00eate en particulier? La r\u00e9ponse est non. Le premier ministre pourrait-il en faire autant aupr\u00e8s de la GRC? La r\u00e9ponse est un non cat\u00e9gorique. Alors pourquoi cette disposition?<\/p><\/blockquote>\n<p>Ces t\u00e9moins et experts de la justice militaire savaient, tout comme la Commission d&#8217;examen des plaintes concernant la police militaire, que les instructions finiraient par \u00eatre rendues publiques. La question est de savoir quel tort serait caus\u00e9 par les exigences ou les instructions du vice-chef d&#8217;\u00e9tat-major dans le cadre d&#8217;une enqu\u00eate, m\u00eame si le grand pr\u00e9v\u00f4t les publiait plus tard.
