Il s&#8217;agit de l&#8217;un des \u00e9l\u00e9ments qui me troublent.<\/p>\n<p>Le secr\u00e9taire parlementaire nous a dit qu&#8217;il y a bel et bien des mesures de protection, puisque les instructions du vice-chef d&#8217;\u00e9tat-major de la D\u00e9fense devront \u00eatre rendues publiques, m\u00eame si, \u00e0 mon avis, ce dernier ne devrait pas se m\u00ealer des enqu\u00eates de la police militaire. Or, quand on regarde le paragraphe 18.5(5), on constate qu&#8217;il y a bel et bien des circonstances o\u00f9 ces instructions ne seront jamais rendues publiques. Le vice-chef d&#8217;\u00e9tat-major de la D\u00e9fense a donn\u00e9 des instructions et s&#8217;est immisc\u00e9 dans une enqu\u00eate si le \u00ab grand pr\u00e9v\u00f4t estime qu\u2019il n\u2019est pas dans l\u2019int\u00e9r\u00eat de la bonne administration de la justice de [les] rendre accessible[s] \u00bb.<\/p>\n<p>Nous sommes conscients que la justice militaire est diff\u00e9rente. Mais n&#8217;est-ce pas s&#8217;\u00e9loigner de la Charte des droits et libert\u00e9s que d&#8217;inscrire dans la loi que les instructions du vice-chef de l&#8217;\u00e9tat-major de la D\u00e9fense ne seront jamais rendues publiques?<\/p>\n<p>[YFjO3YE8X_8]<\/p>\n<p><strong>Malcolm Allen:<\/strong>\u00a0La justice, monsieur le Pr\u00e9sident, doit toujours \u00eatre per\u00e7ue comme transparente et reposer sur des proc\u00e8s et des proc\u00e9dures justes et \u00e9quitables. Pour qu&#8217;il y ait justice, il ne suffit pas de porter des accusations et de d\u00e9terminer ensuite si la personne vis\u00e9e est coupable ou innocente. Il doit y avoir un processus comprenant une enqu\u00eate, des accusations, un proc\u00e8s et une issue. Et le tout doit \u00eatre ouvert, juste et transparent. Id\u00e9alement, tous ces concepts devraient se retrouver dans le projet de loi.<\/p>\n<p>\u00c0 cause de dispositions l\u00e9gislatives sp\u00e9ciales, il y a certains aspects o\u00f9 ce n&#8217;est pas le cas. Pourtant, quand il est question de justice militaire, l&#8217;ouverture devrait \u00eatre primordiale. Il ne peut en \u00eatre autrement si nous voulons que le syst\u00e8me de justice soit v\u00e9ritablement \u00e9quitable et que les gens le respectent. Car l\u00e0 est le v\u00e9ritable objectif: le respect du syst\u00e8me. Il ne faut pas juste penser aux verdicts associ\u00e9s \u00e0 tel ou tel cas. Il faut faire en sorte que le syst\u00e8me soit per\u00e7u comme transparent. Il faut qu&#8217;il soit per\u00e7u comme \u00e9tant juste et honn\u00eate, et rien d&#8217;autre.<\/p>\n<p>Quand les dispositions d&#8217;un projet de loi font toutes sortes de distinctions comme ce qu&#8217;on voit pr\u00e9sentement, c&#8217;est la perception que les gens ont du syst\u00e8me qui est \u00e9branl\u00e9e. Et ce n&#8217;est pas ainsi que l&#8217;on va faire en sorte que le syst\u00e8me de justice puisse se dire \u00e9quitable ou \u00eatre per\u00e7u comme tel.
