Certes, le grand pr\u00e9v\u00f4t pourrait exercer un contr\u00f4le sur les enqu\u00eates que m\u00e8ne la police militaire. Or, avant 1998, l&#8217;id\u00e9e que le chef d&#8217;\u00e9tat-major de la D\u00e9fense devrait se m\u00ealer des enqu\u00eates men\u00e9es par la police militaire n&#8217;a jamais travers\u00e9 l&#8217;esprit de personne. On nous dit maintenant qu&#8217;on s&#8217;est tout \u00e0 coup rendu compte, en 2013, que, depuis 1998, cette s\u00e9paration de pouvoirs aurait, d&#8217;une fa\u00e7on ou d&#8217;une autre, mis en danger la s\u00e9curit\u00e9 des militaires sur les champs de bataille.<\/p>\n<p>Les conservateurs disent que je ne comprends pas et ils ont raison. Je n&#8217;y crois pas. Je ne comprends pas qu&#8217;on puisse accepter que le projet de loi risque d&#8217;enfreindre la Charte pour cette raison.<\/p>\n<p>Je voudrais savoir ce que mon coll\u00e8gue de Beaches\u2014East York en pense.<\/p>\n<p>[auxgrQL0wWw]<\/p>\n<p><strong>Matthew Kellway :<\/strong> Monsieur le Pr\u00e9sident, le gouvernement pr\u00e9sente ce nombre restreint de circonstances hypoth\u00e9tiques et risque que ce projet de loi \u2014 qui est, somme toute, un pas dans la bonne direction \u2014 soit jug\u00e9 inconstitutionnel. Le projet de loi C-15 devrait maintenir les r\u00e8gles et les principes g\u00e9n\u00e9raux \u00e9nonc\u00e9s dans le Cadre de reddition de comptes. Les Canadiens s&#8217;attendent \u00e0 ce que tout syst\u00e8me de justice soit juste et \u00e9quitable. J&#8217;irais m\u00eame jusqu&#8217;\u00e0 dire que la plupart des Canadiens s&#8217;attendraient \u00e0 ce que le syst\u00e8me de justice qui s&#8217;applique aux militaires le soit d&#8217;autant
