Il se souvient peut-\u00eatre que je l&#8217;ai soulev\u00e9e avant le d\u00e9p\u00f4t de l&#8217;accord \u00e0 la Chambre, lequel se fait 21 jours de s\u00e9ance avant la tenue du d\u00e9bat, et j&#8217;ai demand\u00e9 un d\u00e9bat d&#8217;urgence \u00e0 deux reprises. Plut\u00f4t que de revenir sur le manque de d\u00e9bat, concentrons-nous sur celui-ci.<\/p>\n<p>Le d\u00e9put\u00e9 a parl\u00e9 de poursuites lanc\u00e9es par les entreprises, et j&#8217;aimerais m&#8217;attarder quelques instants sur le mot \u00ab entreprise \u00bb. Bien franchement, aucune poursuite n&#8217;est jamais vraiment intent\u00e9e aux termes d&#8217;accords \u00c9tat-investisseur. Comme l&#8217;a d\u00e9crit le d\u00e9put\u00e9, il y a trois arbitres internationaux pay\u00e9s 1 000 $ de l&#8217;heure dans une chambre d&#8217;h\u00f4tel quelque part capables de prendre \u00e0 l&#8217;\u00e9gard des gouvernements des d\u00e9cisions ex\u00e9cutoires qui ne peuvent \u00eatre port\u00e9es en appel. Il n&#8217;est pas vraiment question d&#8217;entreprises dans l&#8217;accord sur les investissements entre le Canada et la Chine. Il s&#8217;agit de la R\u00e9publique populaire de Chine et d&#8217;entreprises d&#8217;\u00c9tat. L&#8217;arbitrage se fera entre deux pays et les circonstances de la R\u00e9publique populaire de Chine seront tout autre que celles des soci\u00e9t\u00e9s am\u00e9ricaines qui intentent une poursuite en vertu du chapitre 11 de l&#8217;ALENA. La Chine pourra, \u00e0 huis clos, exercer des pressions diplomatiques et exiger que le Canada change ses lois faute de quoi elle retirera tous ses investissements. Le d\u00e9put\u00e9 pourrait-il nous dire un mot ou deux sur cette particularit\u00e9 de l&#8217;accord?<\/p>\n<p><strong>Don Davies : <\/strong>Monsieur le Pr\u00e9sident, je remercie la d\u00e9put\u00e9e d&#8217;avoir soulev\u00e9 cet aspect tr\u00e8s particulier de l&#8217;APIE avec la Chine.<\/p>\n<p>Elle a tout \u00e0 fait raison. En l&#8217;occurrence, il ne s&#8217;agit pas d&#8217;entreprises normales telles que nous les comprenons dans la tradition juridique occidentale. Il s&#8217;agit d&#8217;entreprises d&#8217;\u00c9tat. Ces entreprises sont des organisations aux consid\u00e9rations vari\u00e9es. Les entreprises d&#8217;\u00c9tat en Chine ne prennent pas seulement leurs d\u00e9cisions en fonction de leurs int\u00e9r\u00eats commerciaux. Elles cherchent \u00e9galement \u00e0 faire avancer les int\u00e9r\u00eats de l&#8217;\u00c9tat chinois.<\/p>\n<p>Je ne dis pas qu&#8217;il y a n\u00e9cessairement quelque chose de mal avec cela, mais il faut n\u00e9anmoins s&#8217;assurer de ne pas permettre \u00e0 ces entreprises d&#8217;\u00c9tat de poss\u00e9der des ressources strat\u00e9giques cl\u00e9s dans notre pays car elles n&#8217;agiront pas seulement dans leurs int\u00e9r\u00eats commerciaux; elles voudront exploiter ces ressources dans l&#8217;int\u00e9r\u00eat d&#8217;un \u00c9tat \u00e9tranger.<\/p>\n<p>Ce n&#8217;est pas bon pour le Canada. Ce n&#8217;est pas bon pour nos ressources. Ce n&#8217;est pas bon pour notre environnement.
