Cela me prendra une minute:<\/p>\n<p>Sauf dans de rares cas, par exemple lorsque la mesure ou le train de mesures est si rigoureux au regard de son objet qu&#8217;on ne peut raisonnablement penser qu&#8217;il a \u00e9t\u00e9 adopt\u00e9 et appliqu\u00e9 de bonne foi, ne constituent pas une expropriation indirecte les mesures [&#8230;] con\u00e7ues dans un but l\u00e9gitime de protection du bien-\u00eatre public, par exemple en mati\u00e8re de sant\u00e9, de s\u00e9curit\u00e9 et d&#8217;environnement.<\/p>\n<p>Ce n&#8217;est pas mal. Selon le libell\u00e9 du trait\u00e9 d&#8217;investissement conclu avec la Chine, un pays comme le Canada doit prouver que les mesures sont \u00ab n\u00e9cessaires \u00e0 la protection de la sant\u00e9 ou de la vie des personnes ou des animaux, ou \u00e0 la pr\u00e9servation des v\u00e9g\u00e9taux \u00bb. Nous sommes beaucoup moins prot\u00e9g\u00e9s aux termes du trait\u00e9 sur les investissements entre le Canada et la Chine que le B\u00e9nin l&#8217;est lorsqu&#8217;il fait des affaires avec le Canada.<\/p>\n<p>Mon coll\u00e8gue a-t-il de quoi \u00e0 ajouter?<\/p>\n<p><strong>Guy Caron : <\/strong>Monsieur le Pr\u00e9sident, ma coll\u00e8gue a tout \u00e0 fait raison et c&#8217;est pourquoi je suis perplexe quant aux commentaires du secr\u00e9taire parlementaire du ministre du Commerce international. Ce matin, dans sa premi\u00e8re question \u00e0 notre porte-parole, il a dit que cet accord n&#8217;\u00e9tait en rien diff\u00e9rent des autres accords de protection des investissements \u00e9trangers pr\u00e9c\u00e9dents. Au contraire, on peut y trouver des dispositions extr\u00eamement diff\u00e9rentes et inqui\u00e9tantes.<\/p>\n<p>Sans \u00eatre un cas pr\u00e9sentement, nous pourrions devoir faire face \u00e0 des tribunaux administratifs secrets sur demande de l&#8217;un des deux partenaires, ce qui n&#8217;existe dans aucun autre trait\u00e9 ou accord. Le fait qu&#8217;on offre une protection diff\u00e9rente aux investisseurs actuels comparativement aux futurs investisseurs, ceux qui investiront suite \u00e0 la ratification du trait\u00e9, constitue une mesure diff\u00e9rente des \u00e9l\u00e9ments pass\u00e9s.
