  1. Il est possible de se retirer de l\u2019ALENA au moyen d\u2019un pr\u00e9avis \u00e9crit de six mois; le trait\u00e9 d\u2019investissement avec la Chine demeure en vigueur pendant 15 ans. Ce n\u2019est qu\u2019apr\u00e8s cette p\u00e9riode que le Canada ou la Chine pourra donner un pr\u00e9avis \u00e9crit d\u2019un an pour se retirer; cependant, tous les investissements existants seront maintenus pendant 15 ann\u00e9es additionnelles (un \u00ab engagement \u00bb de 31 ans).<\/li>\n
  2. M\u00eame s\u2019il est ahurissant que des soci\u00e9t\u00e9s am\u00e9ricaines (ou th\u00e9oriquement des soci\u00e9t\u00e9s mexicaines) puissent d\u00e9poser des requ\u00eates en dommages-int\u00e9r\u00eats de plusieurs millions de dollars contre le Canada pour avoir adopt\u00e9 des lois sans aucune intention discriminatoire sur le plan commercial, les \u00ab investisseurs \u00bb de la Chine ne sont pas des soci\u00e9t\u00e9s individuelles. Les entreprises d\u2019\u00c9tat de la R\u00e9publique populaire de Chine sont toutes des entit\u00e9s du gouvernement; les conseils d\u2019administration et les premiers dirigeants sont nomm\u00e9s par le bureau politique du Parti communiste chinois.<\/li>\n
  3. Aux termes de l\u2019APIE Canada-Chine, chaque processus de requ\u00eate d\u00e9bute par des efforts diplomatiques d\u00e9ploy\u00e9s pendant six mois en vue de r\u00e9gler le diff\u00e9rend. Suivant cette disposition, la partie la plus puissante sur le plan \u00e9conomique, soit la Chine, serait en mesure d\u2019inclure tous ses investissements au Canada dans une menace s\u00e9rieuse de repr\u00e9sailles \u00e9conomiques. Une entreprise am\u00e9ricaine ne pourrait pas en faire autant dans le cadre de l\u2019ALENA et, de toute fa\u00e7on, l\u2019ALENA ne pr\u00e9voit aucun processus diplomatique.<\/li>\n<\/ol>\n
