										<content:encoded><![CDATA[<p><strong>Elizabeth May: </strong>Mr. Speaker, I want to thank my hon. colleague from Langley, as well as the hon. member for Vegreville—Wainwright. As a specific case, may I say this is one of the most important points of privilege I have heard in the brief two years, almost, that I have been serving here? It cuts to the core of what is wrong with parliamentary democracy that the hon. government House leader could put before you a sports metaphor that we are here as teams, as brands or colours, and we are all to take instructions from our team boss.</p>

<p>We are not here as teams. The principle of Westminster parliamentary democracy is that we are here as representatives of our constituencies and our constituents. We are merely incidentally members of political parties. Political parties do not exist in our Constitution. They are not an essential part of our democracy. They have grown to be seen to be the most interesting thing going on, and we have grown to see politics as some sort of sport. However, democracy is not a sport. We are not playing on teams, and each individual member has individual rights, and the members for Langley and Vegreville—Wainwright feel their rights have been infringed.</p>
<p>I would add that I rose on a point of order to you some many months ago on the question of S.O. 31s and the fact that they were increasingly being used for purposes that, while not against our Standing Orders as they are written, are against the spirit of Standing Orders as described by former Speaker Madam Justice Sauvé, who pointed out that they should typically speak to matters of local concern in our constituencies and should not be used as a place for attacks on others, specifically ad hominem personal attacks.</p>
<p>At the time you said you might comment on that later. Perhaps this point of privilege might give you a chance to further elucidate when it is inappropriate for the approved S.O. 31s from the Conservative war room to be very vicious attacks and the ones that members wish to make about the concerns of their own constituents to be censored and prevented from being presented in this place.</p>

<p><strong>Elizabeth May: </strong>Mr. Speaker, I completely support what we have just heard from the hon. member for Winnipeg Centre. What we have been forced to see is bill after bill, and those of us who have practised at all in the law who are watching recent court proceedings have a grand sense of misgiving that the legislation that has come before us has not been adequately scrutinized.</p>
<p>I am not going to put myself in a position that the hon. government House leader wants us to of making any personal aspersions toward any individual. However, I actually attempted to raise this as a point of order. I certainly appreciate that the hon. member for Winnipeg Centre made it a question of personal privilege. I also feel that my personal privileges have been violated by having legislation brought to this place that clearly has not taken into account the charter implications.</p>
<p>I raised this on March 7, 2012 on the subject of the omnibus crime bill, so-called Bill C-10, because we just had seen the Ontario Superior Court rule on the matter of R. v. Smikle, and it was quite clear that the legislation before us might be, in fact, non-compliant with the Charter of Rights and Freedoms. It is an offence to all of our roles, individually, severally and as a body, to have legislation brought before us forced through by majority vote, which is a disservice to the people of Canada and a disservice to our traditions of law and respect for the rule of law by having legislation here that has not been thoroughly reviewed to ensure its constitutionality.</p>
<p>I thank you, Mr. Speaker, for this opportunity to support the question of privilege that has been raised and to subscribe myself to it. My personal privileges have been violated.</p>

<p><strong>Elizabeth May</strong>: Mr. Speaker, I repeat, I will not say things that have been said by others. I associate myself with comments from other members of the opposition, but I wish to add this for your consideration.</p>
<p>As you can see, tempers are flaring on both sides of the House. We have before us a Canada-China investment treaty without an opportunity to debate it. There is a reality here in terms of motivation, which may affect the deliberate attempt to jam the personal account of the hon. member for Vancouver Kingsway, and that is that the NDP sent out a message urging people to write to members of the trade committee to ensure that they would allow a debate in that committee. In my own office we have received thousands and thousands of emails.</p>
<p>The way this is unfolding and the failure to allow debate in the House, I want to suggest to you, Mr. Speaker, that there is a motivation here to deliberately target the hon. member for Vancouver Kingsway.</p>
<p><strong>The Speaker</strong>: I thank all hon. members for their interventions on this and I will, of course, look into this and come back to the House with a decision.</p>
