										<content:encoded><![CDATA[<p>Elizabeth May, released the following statement regarding today’s tabling of the Standing Committee on Public Safety and National Security’s Report on Bill C-51:</p>
<p>“The Committee has done an excellent job in cataloguing the many, many flaws of the Harper administration’s now infamous Bill C-51. I am pleased that several of the ideas I presented in my brief to the Committee were included in the final recommendations, including:</p>
<ul>
<li>reducing the scope of CSIS kinetic powers, especially the most egregious power to violate the Charter;</li>
<li>increasing the scope and resources of national security review bodies;</li>
<li>removing the egregiously overbroad terminology ‘terrorism in general’; and</li>
<li>enhancing the redress program for the no-fly list.</li>
</ul>
<p>“However, it is also clear to me that the Government can and must go further to undo the damage of C-51. There are only two explicit repeals recommended in this report – s.12.1(3) of the CSIS Act and the two-court system for criminal cases under the Canada Evidence Act. My recommendation was to repeal entirely sections 1, 3, 4 and 5 while modifying section 2 of C-51. Without a full repeal and replace strategy, the government risks building their national security policy on a deeply flawed foundation. We are also left with a set of laws that risk violating the fundamental liberties of all Canadians. I urge the Government to take this report as a floor, not a ceiling, of what is possible in undoing the harms of C-51.”</p>

										<content:encoded><![CDATA[<p><strong>Elizabeth May</strong>: Mr. Speaker, I would like to thank my hon. colleague for an excellent presentation on the things that are missing from the bill. I wonder if I can turn attention from the pricing, which she quite rightly pointed out is the elephant in the room, and ask about a concern I have that the private freight controllers, the companies running our freight, have been cutting back in a dangerous way on the personnel on board.</p>
<p>We no longer have people on board in the last car, the caboose, which used to be required under regulation, to monitor safety. I believe that the spill at Wabamun Lake, which the hon. member for Edmonton—Strathcona knows about very well, occurred largely due to the cutbacks of key safety positions of personnel on board freight.</p>
<p>It needs to be reliable and safe. We are having far too many derailments.</p>
<p><strong>Olivia Chow</strong>: Mr. Speaker, the Transportation Safety Board of Canada has made a series of recommendations, some of which are on staffing. Others are on the need for advanced technology to be installed in rail cars. For example, voice recording in the locomotive cab has not been done yet, even though the recommendation is eight years old.</p>
<p>There has been a recommendation for a positive train control system that would provide an automatic braking system. If the conductor happened to miss a light, a track or a red light stop sign, the train would stop automatically based on GPS technology. Unfortunately, that recommendation is again being ignored by the minister. The United States made it mandatory that all trains have automatic braking devices for safety, but we do not have such legislation in Canada.</p>
<p>Therefore, both staffing and technologies should be in place to keep train services safe.</p>

										<content:encoded><![CDATA[<p><strong>Elizabeth May:</strong> Mr. Speaker, I would like to thank my Bloc colleague for his comments. I too support this safer railways bill, which is very important for Canada.</p>
<p>I make the point now only to say that I think the House is moving to a place where we may have wanted to be some time ago. Members are prepared to see the bill pass. I just wanted to add my words of support for the bill. I think the House is perhaps unanimous.</p>
<p>I turn to my friend in the Bloc and ask him if he has any additional points.</p>
<p>We do need to ensure that rail safety is a priority. This is a very important bill, even if it is a housekeeping bill. I hope that, once it is passed, we can move on to look at the other issues that have come up in debate about improving access to rail, passenger rail, improving the freight lines and potentially moving Canada into the 21st century of rail travel through high-speed rail. However those are all points that go beyond the legislation before us.</p>
<p><strong>Jean-François Fortin:</strong> Mr. Speaker, I would like to thank my colleague from Saanich—Gulf Islands for her very apt comment.</p>
<p>We have indeed reached a point where all parties in this House agree on passing this bill. I believe that it is important to improve safety, as my colleague mentioned. There is no doubt about it. Earlier, I alluded to apple pie. Who can be against apple pie?</p>
<p>We need to move on to the next step. The bill must be passed. But I wish to reiterate that it is important for the government to have a clear policy that will provide the railways, no matter where in Canada they might be located, with funds to maintain costly infrastructure, because the railways are invaluable from the environmental, sustainable development and transportation standpoints, whether we are talking about transporting goods or passengers. What is needed is a clear investment policy for the railway network across Canada.</p>

										<content:encoded><![CDATA[<p><strong>Elizabeth May:</strong> Mr. Speaker, I would like to ask my hon. friend from the riding of Edmonton—Strathcona to reflect more on the lessons learned from that really devastating toxic spill that occurred in Alberta near her home. If I recall, the hon. member had a cottage on that lake and experienced first hand some of the reasons for the derailment.</p>
<p>This legislation, while sound, in my mind will not sufficiently deal with systemic problems from the cutbacks to rail staff and cutbacks to safety regulations. I would like to ask my hon. friend if she would agree.</p>
<p><strong>Linda Duncan:</strong> Mr. Speaker, I would like to thank the member for Saanich—Gulf Islands for her cogent question. I know she is a great defender of the environment as well.</p>
<p>Absolutely, I have witnessed first hand the devastation that can occur when we do not properly regulate, inspect, and enforce our rail laws. This is harm that should not happen to the environment. It is preventable. This is the disgrace of it. It is absolutely incumbent on the government to reverse its policy of turning over more and more of the responsibilities for inspection and the monitoring of critical laws like rail safety. I am looking forward to the government stepping up to the plate and saying that it realizes this law is important and showing good faith and actually bringing forward some cases, putting more inspectors out there and making sure that these lines are inspected more sufficiently, and also putting in place the proper technology so that it can actually detect the rail line errors.</p>

										<content:encoded><![CDATA[<p><strong>Elizabeth May:</strong> Mr. Speaker, I think all of us are very pleased to see Bill S-4 reflecting the spirit of co-operation of all parties who are concerned with rail safety in this country.</p>
<p>I would also like to ask whether we can see the kind of commitment that would extend rail safety by providing the additional kind of equipment, the automated brakes on speed and so on, that could avoid accidents. The member has spoken to this point, but I would really like to see the kind of solid commitment that goes along with this excellent legislation.</p>
<p><strong>Mark Adler:</strong> Mr. Speaker, as the member knows, regulation and legislation are living, evolving creatures and are subject to debate and exchange within parliaments and committees.</p>
<p>We have here a great piece of legislation that really deserves the support of every member in the House so it passes swiftly and expeditiously. The safety of Canadians is at stake right now, and we have put forward a bill that would address all the safety concerns and would put the safety of Canadians first. I would urge all members in the House, rather than nitpick, to pass the bill expeditiously and swiftly.</p>

										<content:encoded><![CDATA[<p><strong>Elizabeth May:</strong> Mr. Speaker, I thank the minister for his speech and for the improvements in railway safety represented in Bill S-4.</p>
<p>I would like to ask him if we could take it further. I certainly agree with my colleague, the hon. member for Esquimalt—Juan de Fuca, about how tragic it is when rail lines are not making their way to city centres the way they should and we are losing service across the country.</p>
<p>As a frequent VIA passenger myself, I have noticed that there are often rail delays, which then lead to the crews trying to make up with speed later on, and we know that can have tragic consequences.</p>
<p>A lot of this is due to the fact that the railway sidings are shorter now than the average length of a freight train, and since passenger rail must lease space and rely on freight for its signalling and safety, we have conflicts.</p>
<p>Is there anything the minister thinks can be done to invest in longer sidings and better transit connections so there is better sharing of the rails between passenger and freight in the interests of safety?</p>
<p><strong>Hon. Denis Lebel:</strong> Mr. Speaker, for sure and the way we will manage the bill and the continuation of it, we will respect the jurisdiction of provinces and municipalities. We are working with them. We have invested over $5 billion in public transit in the last years since 2006 and we will continue to do so. That is very important for us.</p>
<p>With regard to signalling, we have some very important changes in the bill, which have already been implemented by Transport Canada, and for sure everything will become safer. With all the railways in this country, we will do what we are able to do about that.</p>
