Elizabeth May: Mr. Speaker, I would like to thank the hon. minister for making himself available for half an hour to discuss why we should not be limiting debate on a bill of this importance.

I would like to ask the hon. minister if he does not think that a bill of this magnitude and importance would be improved by ensuring that when we bring forward sweeping changes to refugee and immigration law, the government has the support of those people most intimately involved and most knowledgeable? I refer to groups like the Canadian Association of Refugee Lawyers and the Canadian Bar Association. We should have legislation which we are sure would meet any charter challenge before we pass it.

Hon. Jason Kenney: Mr. Speaker, I appreciate the member’s contribution to debates in this place, but I could not disagree with her more strongly on this particular point.

There is a widespread consensus that the current asylum system is dysfunctional. Yet there are certain discrete special interests, including the so-called refugee lawyers association, that are the core special interests who want to protect the status quo. They are opposed to any meaningful reform. Frankly, any model of refugee reform that that organization supported would continue the dysfunction of the asylum system.

What we are proposing in C-31 goes above and beyond our legal and humanitarian obligations under both the Charter of Rights and Freedoms and the UN convention on refugees. It proposes an asylum system that would be universally accessible and that would respect absolutely our obligation of non-refoulement of people deemed to be in need of our protection. It would provide access to a full and fair hearing at an independent quasi-judicial body, which again goes above and beyond our charter and UN convention obligations. It would create for the first time a full and fact-based appeal at the refugee appeal division, accessible to the vast majority of failed asylum claimants who lose at the first instance.

This is something that I think any reasonable person could support. However, we will not allow ourselves to be blocked from meaningful reform, to provide protection to real refugees by the special interests who have helped to create the problems in the first place.

Ms. Elizabeth May: Mr. Speaker, I have a question for the hon. member for Kelowna—Lake Country.

[SGvsT9JdEKE]

I have a copy of sections of the proposed Canada-Panama agreement, including article 9.11 regarding expropriation, which describes it as being, in effect, equivalent to nationalization or expropriation except for public purposes. The language would not worry people if we did not have the experience of similar language used in chapter 11 of NAFTA to undermine decisions taken by the democratically-elected House in relation to bills that protect human health and the environment. I specifically recall the issue of the Ethyl Corporation challenging the Government of Canada.

Will the hon. member commit that we will have adequate time in the House at second reading to look through the implications of this kind of legislation, or are we to have debate closure once again?

Mr. Ron Cannan: Mr. Speaker, I had the opportunity to be in the riding of the hon. member on Friday to open up Canada’s largest indoor climbing wall. It is an incredible facility. Gary Lunn, who was the minister of the day, partnered with the province in this significant asset for Canada.

One of the specific questions that the member asked was on rules-based trading. It is significant and something that has been called for by businesses coast to coast to coast. They have come to our committee asking for some certainty and predictability.

We also have the side agreements on labour and the environment, which will be debated at committee. We will then come back at report stage when we will have an opportunity to debate those issues as well.

I want to reiterate for all sides of the House the significance of moving this project forward. The Minister of International Trade was in Europe last night and will be working for the next 10 days or so with the World Trade Organization.

There is an excellent article in The Canadian Press that came out last night. It talked about how Canada was working with Brazil, China, India, as well as Panama and Jordan. We are diversifying markets, as was committed to in the throne speech by the Prime Minister, so we can create jobs, hope and opportunity for Canadians from coast to coast to coast.

Ms. Elizabeth May: Mr. Speaker, as it seems that the debate has just begun at second reading, I ask the hon. minister, what is the reason for any haste at this point to invoke closure on debate yet again? Frankly, I am quite shocked by this and I would like to hear some attempt at an explanation for why the House of Commons cannot continue to debate this important legislation.

[Die5ey2HaQo]

Is the House of Commons and parliamentary practice now merely a nuisance for the government of the day?

Hon. Lisa Raitt: Mr. Speaker, it has been very clear that we view trade as important to this country. In fact, we are the most trade-dependent nation there is in the G8. We have seen great results from trade. Time is of the essence. It is very important that we move on with the economic recovery and with our trade agenda.

I am very pleased to outline all of the benefits for Panama with respect to labour agreements, funding and helping capacity. Quite frankly, the sooner we get on with this the better.

Ms. Elizabeth May: Madam Speaker, with all due respect to the hon. minister, the motion before us is not a question period for the minister on the substance of the bill. It is a motion to limit debate. My comments, like those of other hon. members, are to that subject.

When I first started to come to this place, it was a great privilege to see sitting at that table an honorary table officer, Stanley Knowles, who served in the House and was a great parliamentarian. He said in 1965:

The whole study of parliamentary procedure over the years, indeed over the decades, has been an endeavour to find a balance between the right to speak at as much length as seems desirable, and the right of parliament to make decisions.

I suggest that hon. members on the government benches have not struck the right balance, that when you invoke closure and time on debate over and over again, you lose legitimacy not only in the eyes of the opposition parties, but in the eyes of those people who elected them as members of Parliament.

I ask them to please allow proper debate on the bill.

Hon. Gerry Ritz: Madam Speaker, we have done just that. I have not heard anything different in the last 10 minutes, the last 10 days, the last 10 weeks, the last 10 months, the last 10 years on the debate around the Canadian Wheat Board.

We are following the mandate that we were given on May 2 to come here and use whatever parliamentary means, which we are doing, to ensure this would get through the House and move on in a timely way to give clarity and certainty to the complete industry in western Canada.

That is exactly what we were sent here to do and that is exactly what we will do.

Elizabeth May: Mr. Speaker, from 1913 to 1956, a period of over 40 years, time limits on debates were used 10 times. In the last 40 days, a time limit has been used seven times, making a new historical record.

What used to be the exception to the rule appears to now be the rule.

[UO2Blgpb168]

Some hon. members: Oh, oh!

Ms. Elizabeth May: I am only sitting because I cannot be heard.

Some hon. members: Oh, oh!

The Speaker: Order, please. We will hear the rest of the question.

The hon. member for Saanich—Gulf Islands.

Ms. Elizabeth May: Mr. Speaker, my question is for the government House leader. Can we again restore a parliamentary tradition that limits on debates occur when matters are urgent or otherwise justified and do not become routine?

Hon. Peter Van Loan: Mr. Speaker, in the last election Canadians gave us a strong mandate to deliver on jobs for Canadians–

Some hon. members: Oh, oh!

The Speaker: Order, order. The House wanted to hear the question and I am sure the House wants to hear the answer. The Chair wants to hear the answer.

The hon. government House leader.

Hon. Peter Van Loan: Mr. Speaker, Canadians asked us to deliver on tackling crime, on creating jobs for Canadians, on restoring the democratic principle of each vote having equal value on a range of commitments, and we are delivering on those commitments.

But what has happened each and every time is that the opposition has brought in a motion to stop debate, to say those bills should not go to committee, they should not go past second reading.

We will not stand for that. We will deliver on our commitments and ensure that the House has a chance to decide and debate these issues thoroughly at every stage.
